    You can buy them here its not exactly accurate. I lived in Germany well West Germany and the difference is there is no toy inside of them in the US.

    Everyone is missing the point on Kinder Eggs. The eggs with embedded toys are banned because of a 1938 law which prohibits non-food items embedded in food. Oversight for this law is up to the Food and Drug Administration, one of many incompetent, nanny-state entities of our ever-growing bureaucracy. Thus sensibility is not a prerequisite for action. Fortunately, the FDA has nothing to do with guns. If they did, we probably wouldn't be able to have caulk guns or water pistols.

    Its not just that it has a non food item inside of it. The CPSC is very big on age ranges for toys. They will not allow toys with small parts to be sold if they are marketed towards children that might swallow it. You go into any toy store in the US and every toy in there will have an age appropriate designation on the package.

    1997, the staff of the CPSC, the Consumer Product Safety Commission, examined and issued a recall for some Kinder Surprise illegally brought into the US with foreign labels. The staff determined that the toys within the eggs had small parts. The staff presumed that Kinder Surprise, being a chocolate product, was intended for children of all ages, including those under three years of age. On this basis, the staff took the position that Kinder Surprise was in violation of the small parts regulation and banned from importation into the US.

    In 2012, the FDA re-issued their import alert stating “The embedded non-nutritive objects in these confectionery products may pose a public health risk as the consumer may unknowingly choke on the object”.

    So if I bought a blow-up doll ( hypothetically, naturally), with small parts, would I be denied ?
    OK....no quizzing the size of my parts is allowed as a smart response here. Nor my age.
