    Yes beyond the gate to the nursery. My front door isn't affected by the gate. I don't have to open the gate in order to open the front door, it that's what you mean. I would have known much sooner if that was the case.

    A constant irritation like that can really be a ****ing nuisance.

    Have you checked that they had planning permission to put it up in the first place? I'm guessing it must be some size or it wouldn't be noisy enough to be disturbing you and there are height restrictions. Also be careful which route you take to complain about, if permission to attach the gate to your property is primary concern, don't go for noise as it may be within acceptable limits, but encroaching on your property isn't.

    I'd imagine that if the gate is fixed to your property then your permission should have been gained before they put it up.
    I'm no legal expert, though, so make sure before you start shouting the odds.

    On the other hand, you could just send them a polite :) letter explaining the situation and ask them to deal with it.

    Why didn't they just attach it to the wood post that was already there instead of to the brickwork.

    I believe that even if it is a party wall, they'd still need to serve you notice of any changes.....had something similar a long time ago....I resolved it by fitting security lights and adjusting all of them to shine into his house.....specifically his bedroom window until he removed railings that limited access to my drive. There's always a way <laugh>

    Ok. If you've got no right of way beyond the gate (and it sounds like it's a dead end and you've not got an access point to your house beyond it) then you're quite within your rights to tell them to take the ****er down (or you can)

    BUT, if the land is all theirs i.e. right up to your wall, and it's not shared. then they'd be quite within their rights to simply put a gate post in, that adjoins your wall but doesn't attach to it, and refit the gate. So that's not going to solve your problem.

    I assume it's a full blown nursery and not someone who's set up as a child minder in a residential property?

    The noise route wouldn't work imo if the property has commerical use granted, unless it was extreme and not just the clanging of a gate.

    Your best bet is probably to go and speak to them in the first instance and tell them your beef. See what reaction you get and go from there <ok>

    I had a similar issue with an aircon unit in a shop below my apartment.
    There was a planning permission thing posted up there, but it didn't change the fact my apartment had what could be considered as a fridge humminh noise through my whole apartment. Cavity blocks turn the walls into speakers.

    The guy had to take down the aircon and mount it elsewhere , he did so after I invited him into my apartment to have a listen.

    He could probably invite The staff in to listen and they would probably try to use the gate quieter... Kids on the other hand are all bastards and will be noisy.

    He could probably get them to detach the gate from his house (they shouldnt have done that) but they will probably still put it back up again somehow.

    The best solution might be to kidnap a few of the kids and leave body parts around latchford. Parents will stop taking the kids to butterfly nursery then.

    It's a tiny job for a builder to build a gatepost pillar that does not connect to the house wall, they just took a cheap ass shortcut ;)
