Parking Eye are members of the British Parking Association Ltd, the largest parking industry association in the UK. As part of their Code of Practice they are required to offer an independent appeal, should an initial appeal to Parking Eye fail (as they often do). The BPA’s independent appeals service, POPLA, are known to uphold appeals for Parking Eye tickets when the genuine pre-estimate of loss argument is made. In short, for a ticket issued for breach of parking conditions, they may only recover the loss caused by that incident (i.e. did staying 10 mins over really cause £100 loss to Parking Eye?) . To the authors knowledge, Parking Eye has never been able to demonstrate genuine loss, so to date, all appeals citing that have been upheld. Appealing to POPLA has been a very straightforward and clean way to avoid paying a Parking Eye ticket. Mike it is private land enforced by a private contrator.... I dont need to see the signs. They cant fine you as its contract law. They can only recover their lost revnue. How much did they lose when you "parked/stopped" in their free car park? £0 I know it takes cahoonas to ignore threatening letters but thats what I would do. If you dont fancy ignoring them, then appeal citing the poor signage all the stuff you threw at LCC last time, threaten them with an ombudsman andcounter claim. Tell them that you will seek costs of £100 per letter if you have to write any more. The problem with this is they have then confirmed thry have your attention and wont leave you alone.
Good advice, not as good as ignoring them... They aint going to go to court to recover £0 as the court will always award costs against them. BPA is just an organisation for crooks. a bit like a parking mafia.
Tell'em to go get ****ed, what this country needs is a bit of civil disobedience got clamped near QPR's ground years ago, near a petrol station, bottom of South Africa road I think it was called, so I started to break the lock off, then along came this ****ing cockney cowboy clamper saying I owed him money, i told him to go **** himself, and if he doesn't take it off my car I'll wrap the wheel brace round his head, after a few minutes arguing the big useless soft **** took it off and did one
In my instance my car was breaking down and needed anywhere to stop it, I was outside a shopping centre so just pulled in as the car cut out.
one of my mates works as security for a company that does this very thing. Always has stories where he gets into full on fights over this sort of thing (its actually more of a tow company but the same thing), hence the need for a security job associated with it.
