Damn, I had just written something with assumptions saying that the contract may be as described in that link. AM didn't see him in their future plans so as stated in the link the contract could have said...

Saints loan Toby and pay some of his wages
Saints agree to purchase Toby for £6.5m on 1/7/15 and agree a contract with Toby
AM can cancel the purchase of Toby by paying Saints £1.5m before 1/7/15

If that is the way the contract was written and AM missed the deadline I can understand why the lawyers would get involved if he was sold to someone else, as in effect AM don't own his contract any more as we do.

If AM have blundered and Levy is now aware that we already have an agreement to sign Toby then the honourable thing for Spurs to do is withdraw their offer and look elsewhere. Obviously honourable and football don't really go together.

Alderweireld is going to Spurs at a great price. One which we could and should have easily paid.

Unless Alderweireld has refused to sign here, it really points to Saints having screwed up badly somewhere.

Nope it points to AM going against a contract.

Not really. Spurs have-- as far as we know-- reached an agreement with AM in good faith, and the player wants to play for them. AM's alleged payment blunder has nothing to do with them, and if it went to court Alderweireld would almost certainly be allowed to leave.

Atletico have breached an agreement with us and may have to pay us compensation. That is between us and them and has nothing to do with Tottenham and Alderweireld.

I think you missed my point. If Spurs are now aware that we have a prior agreement then the honourable thing to do would be withdraw.

I must say that an alarming number of people seem happy to accuse Saints' management of incompetence without ANY knowledge of what's happened or is going to happen. It would be just as valid to say that Saints' management team have done a wonderful job ref Toby. And equally divorced from any factual basis.

Spurs have no idea whether our claims against Atletico are valid. That will be for a tribunal of some sort to decide. If the tribunal decides we do not have a valid claim to Alderweireld, then there is no reason Spurs should have to withdraw their bid. If the tribunal decides we do have a valid claim, then their transfer is void anyway.

That's what courts are for. To decide things fairly so parties don't have to take matters into their own hands.

Trouble is we have no idea what Spurs know. My whole point was based on if they did know about any agreement we have. We all know what courts are for.

We may think we have little chance of signing Toby, but want our compensation....said to be about 3.5 mill if he is sold to another club (conjecture only). Or we believe that AM have been playing sides against the middle and we are seriously pissed off...and will see them in hell first. I know which if Nicola was still here, but we may settle (bearing in mind Katharina's dislike of bad publicity). If Spurs go ahead with the medical, we could always offer them a few quid for it if we sign Toby....no point in wasting money. :)

If the player hasn't signed on the dotted line for you guys then it really doesn't matter what has been agreed by the 2 clubs. You could kidnap him and force him to play at gunpoint, i guess.

They probably know of it, but thought it had been sorted or AM would pay us out of the transfer fee. Doubt if they'd read the small print...they would trust Atletico on that. See little reason to blame Spurs on this.

Wouldn't have to...Toby is an honourable soul. He has always said it is down to Atletico and he likes it at Saints....have no doubt, he'd also like it at Spurs. You won't get hysterics from him.

If only that were the norm with players today. We got burned with Willian; paid for his air fare, medical, etc. and he rocks up at Chelsea instead.

No I agree that they probably thought it was all sorted. My point was now they know it's not what hypothetically could happen if they had all the facts (and I mean facts not speculation like we all have). I really wish I hadn't mentioned it know.

Must say that it should be down to Toby, if he wants to join Spurs then let him go. Make sure that Spurs pay top dollar for him though

RK said, in his return to work interview, that Atletico were being difficult over the Toby transfer, which suggests that we had been pushing for the deal to be concluded, and hadn't fannied around, as some are suggesting.

Should he end up at Spivs, how confident are they that he will form a solid partnership with Verthongen? Yes they play together with Belgium, but Toby is their right back, not CB. They may not be compatible.

Well it certainly up to him, but he doesn't seem to be offered with the choice; there are only Spurs who have an offer for him accepted by Atletico, so between what is he to choose exactly?
