Latest reports were saying an £11.4 million fee had been agreed by Spurs. We could well be using this to get them to accept our bid. At the end of the day it's Toby's decision, regardless of what contracts/fee's have been bounded around.

There are three possibilities I can see:

    1) Atletico push through a deal with Spurs, we then sue them (and Spurs?). Best result here is that we get compensation for breach of contract
    2) Alderweireld REALLY wants to come here and refuses to sign for Spurs, forcing Atletico to sell to us
    3) Southampton go to whichever is the appropriate court ASAP and get an injunction preventing Atletico from selling the player to any other club

I'd say Option 1 is very possible, I have no idea how likely Option 2 is and I'm not even sure Option 3 is possible.

Any chance that people can please hold off from going onto the Spurs board (although I see that Tom already has). Nothing is confirmed yet, and I'd rather not have another Spurs WUM infestation on this board if this ultimately leads to nothing and Toby still joins them.

Kind of. Only if Toby does want to come here. I have no problem annoying Atletico, but I don't want to manhandle a frustrated player to the club via the courts.

Surely it would be easier to Atletico to sell to us rather than risk having to pay us compensation.

I'm guessing that's what we're going for; this card was held in reserve until such time as it appeared Alderweireld might be signing elsewhere. If there's merit to the complaint, Atletico's path of least resistance is then to sell him to us (likely with us magnanimously giving them a fair bit more than the 6.5m to grease the skids).

Wouldn't be the craziest transfer foul-up ever, if true, but it's up there.

Interesting to see how Tottenham are clearly feeling second best to Liverpool in the 'clubs we dislike most' race, and therefore via their fans are putting in a late charge to reclaim top spot.

I will settle for whatever Toby decides, whichever way it goes. Just hope it is a storm in a tea cup and all gets settled sensibly.

Yes, this is what I was thinking. Surely the thinking is: Hey, we could sue you for loads of money - or we could give you just as much money as Spurs. You choose. Us and loads of dough or Spurs and a potential court case...

That said, this is a rather sad way for this to progress.

I would suggest that we could not sue Spuds as the breach of contract would be against the contact held between AM and us. Would be very messy and, as St Bendy has written, probably slapped wrists all round and a small compensation payment to us.

The question is, however, where does Toby want to be next season? If it is with us - then I would suggest it's 'game-on' as logically AM will want the cash now and you could be pretty sure that Spuds will not hand over any cash until they know that Saints legal action is closed out. So all would hang in abeyance for quite some time...

Way this is going, he'll go and break a sodding leg in pre-season for whoever gets him.

Or they could get heavily fined and ends up costing them more than it would selling to us.

So, from inference, you're saying that if Toby does sign here: party on the Spurs board?

I suppose it depends on the exact wording of the contract we had with Atletico. If there's any room for argument Atletico may take the view that Saints won't actually go to court - any case we brought would take a long time to be resolved and generate a lot of legal costs with no guarantee of success.

This. I reckon we are doing this as they aren't playing to the rules, and forcing their hand.

And also, AM have got their reputation to consider. Do they want their name splashed all over the media for the wrong reasons?
