Gross misconduct five years before termination entitles the employer not to pay notice pay 14 May 2015 In the case of Williams and Leeds United Football Club [2015], the High Court considered whether the claimant was entitled to be paid 12 months’ notice pay, despite having been found by his employer to have sent pornographic images to three individuals five years earlier, which conduct was discovered after he had been given notice of termination. When the club discovered the claimant had sent the pornographic pictures, it argued that this was a repudiatory breach of the employment contract between the parties, and the club was therefore entitled, on a strict contractual basis, not to pay the claimant’s 12 months’ notice. As background, Mr Williams was in a senior management role at Leeds United Football Club. He was on a salary of £200,000 per annum. I am now looking for my post re Adam Smith as you will note and I must thank Matt for finding it as you are all aware I am computer illiterate that article was posted on the 28 January some 4 months before we signed him and to the best of my knowledge months before even a rumour got out With regard to Adam Smith who incidentally plays for Bournemouth now I wrote to Simon 2 weeks before he signed advising Simon to look at him .He must have liked what he saws he was actually playing on loan for MKDONS FROM SPURS Many thanks again Matt for your help perhaps we can find the other article re Adam Smith to shut up the court jester and his assistant

Adam Smith the best right back I have seen since Paul Reaney very fast and again good crosser and has a verocious shot, well worth a punt at500k no ego and at 20 will only get better.
