FA statement: Hull City's proposed name change

    The application was to change the name for the 2014-15 season. The FA rejected it and the panel said it will be inappropriate for the council to make a fresh decision this season, on the old application presumably. In legal terms the old application has effectively lapsed and the FA do not have to act on it. To change the name he needs to submit a new application either this season or next.

    His only other recourse is to go to the High Court.

    His stance of not submitting another one is a carbon copy of the CAS stuff. It'll be corrected on the OWS in the next couple of days with another error-strewn statement that raises more questions than answers. The outcome will be a new application I'm sure.

    He can't go to the High Court without being in breach of FIFA regulations though, can he?

    Yes, going to the High Court would put him in breach of the FIFA regulations. But its his only option if he's not going to put in a new application.

    If you don't like the rules you don't join the club.

    Football is completely self-regulated. It helps protect clubs from arbitrary legal cases. He could test it in the courts but failure would mean Hull City being in a league of their own with no other clubs. The Kerry Packer of football. Goodbye to the Sky millions.

    Isn't all of that challengable if someone felt so inclined?

    Is it not so much that the rules prevent it, but there are consequences for a failed challenge?

    Even a successful one to my understanding. Basically, you may be right, you may be wrong, but whatever the outcome, you won't be welcome back in our member's club. And as Obi said - that's where the millions are.

    Everything is open to challenge but what is the price of failure. Its the risk you take with all legal action. A sensible person looks at what failure will cost. In this case failure could mean expulsion from the FA. Is it worth the risk when all he has to do is put in another application.

    Am I understanding this correctly?

    The FA criticized the so-called 'poll'; the FA further criticized the lack of business plan; and the Application was set aside, due to 'bias' (undeclared) by FSF committee member?

    But AA still intends to submit the very same application?

    No he thinks the FA should accept his last one despite the panel saying they don't have to consider it this season.
