Thats why the whole issue of informed/uninformed consent is such a grey area legally speaking. Somewhere there is fine line between a conscious yet drunken decision and someone taking advantage of someone else when they're in no state to consent to sexual contact. But that line is so fine its practically invisible at times and its hugely open to interpretation from both the standpoint of a jury and the person reporting the crime, if I'm to be highly, highly cynical. For a young man its a worrying situation that you have to be hugely wary of at times. Alcohol and other substances make rape and sexual assault as crimes such a maze to justly convict or acquit. There are some cases, perhaps this may be one of them, where we never know what the truly just outcome may be.
A first read tells me that this whole thing remains very ambiguous. As I posted earlier, it places a huge onus on a young ( probably equally intoxicated ) man. Slightly misjudge the situation or the lady, get the wrong jury, and all of a sudden the rest of your life is ruined.

After today's results, I predict that Stuart Pearce will be sacked by Forest within he next few days and I predict Darren Ferguson will be sacked by Peterborough within the next few days.
Given the investment at Forest, I'd say that Pearce has been walking a tightrope since their form dropped off. Great start, lost to us and then **** ever since. Very odd. Peterborough's chairman has sort of backed Ferguson, though. He's posted a series of tweets slagging off their players, the ref and some of the fans, anyway!
Peterborough were second after around a dozen games, but have had the worst form in the division since. Ditto Forest. When you're expected to challenge for the play-offs at least and are now mid table, your prospects are slim in today's game. Had they started badly and been on the up, they may have stood a chance. But it's the reverse; that means curtains for both soon, I think.

I can't accept that. In the vast majority of these cases we are dealing with two young people who have had too much to drink. Yet the onus is placed on the man to exercise a judgement that he most probably is in no fit state to make. There have been well documented cases of girls only crying rape when the sobered up and subsequently regretted what they'd done. Some have even been found guilty of perjury. In this case, there is absolutely no evidence apart rom one person's word against another's. For reasons known only to them, the jury decided that they believed McDonald and not the girl. In Evans' case they reversed their decision. Bizarre, to say the least.

In a situation like that, nobody is going to think, "oh, I better be careful here, she might scream rape afterwards, and I'll go away for 5 years" you don't stop to evaluate risks! It's not a business decision!.... Never did in my case. Only an extreme amount of it would stop the old fella from rising to the occasion.
