You meet a girl on a night out or after a date and take her home, you start kissing her on the sofa and say let's go upstairs, you go into the bedroom and start taking her clothes off. I've never once stopped what I was doing and asked a girl that specific question and no girl has done the same thing to ask me. Does that mean that we both raped each other? Unfortunately for the prosecution there was no evidence that MacDonald was aware Evans was going to turn up so he was found not guilty. The Appeal Court judges said that there was filmed evidence of the inside of the hotel room up to the curtains being closed. That would have shown how drunk she was and if it included MacDonald having sex with her, how energetic she was. You have the same idea of whether she was playing the game as I do. However if you believe Evans, there was no spit roasting. If there had of been MacDonald may well have been found guilty. Penetration of her mouth without consent is rape according to Section 1 of the Sexual Offences Act 2003. MacDonald would have been in the same boat as Evans regarding consent. He would have had to prove before Evans turned up she had agreed to a threesome. The jury convicted Evans and 4 judges decided that the conviction was "safe".

Here the full quote from the official transcript: "10. The applicant's two companions remained outside the hotel. They looked through the bedroom window and filmed what was taking place with a mobile telephone until the curtains to the bedroom were closed."

No, I haven't changed my mind, as the video was unusable as it contained indiscernible images, the fact that it wa taken isn't in question, but it's ****ing irrelevant and therefore couldn't be used as you suggested to prove she was incapacitated
