Well, if he asked to 'join in' whilst macdonald was shagging her she was clearly conscious or he'd have been done for rape as well. By the logic that he proved it was consensual we must assume she was conscious the whole way through, otherwise it becomes rape doesn't it? If i've got that wrong then sorry but I assumed if a woman fell unconscious while shagging her you're kinda meant to stop.

Well I highly doubt Macdonald would just let him walk in and join in without even a word would he? Don't know what your basing this 'he just walked in and started' stance on. There was time where Macdonald and Evans were in the same room and to assume no interaction took place between the three of them is ridiculous. As I stated, if she was unconscious when evans joined in she must have been unconscious during having sex with macdonald which, if i'm not mistaken, would count as rape. Of which he was found innocent.
That's why I used the ' 's. The amount of violence used is not just the deciding factor on how the victim is affected in rape. By pepole saying that being dragged down an alley and raped by a stranger is any worse than a husband raping his wife while she lays motionless and not defending herself is plain wrong. Rape is about power and control. By whatever methods are used.

Agreed. And forced, physical rape is obviously worse. Why is everybody so bothered about this case? I don't see you all arguing for or against every other rape offence that happens every day.
I think there's a few reason, it's because of the witch hunt, the high profie it has had over the last few days and also that a lot of men are thinking "holy ****, there but for the grace of God go I" cos if you have sex with a girl who is over the drink drive limit you are open to a rape charge.
