‘I really thought it would have been thrown out of court and I was stunned when I was convicted. I had done nothing wrong. It was something that should never have happened. High profile person sneaks out after cheating. Never happened before, ever...... Also she may well have agreed. She couldn't remember though. Infact she couldn't remember agreeing to the other guy either.
The same as MacDonald, he was found not guilty. She want willing with MacDonald to an hotel room and had sex. All her behaviour implied consent and he was found not guilty. There is no CCTV evidence of her with Evans other then her lying in the street and him looking on. There is no evidence that she talked to him before he let himself into the hotel room unannounced. He lied to get the key and walked out the fire door to avoid being seen. He gave evidence in the box and the jury thought he was not telling the truth so convicted him. My advice would be, if your mate picks up a drunken woman think three or four times before you join in, especially if there's no CCTV coverage of you all going to the room together.
Talking of Eastenders, being convicted of murder wasn't an obstacle to someone following their career on there.Yet for a footballer convicted of rape, an act where violence didn't occur and would more accurately be described as taking advantage of a drunk young woman, there is to be no chance of doing the same.
You've ignored the possibility that she may have been made aware of the chances of chasing him directly via a civil action I hope that clears up your complete ignorance
You know how to use google why not use it yourself. Her behaviour on the footage in going to the hotel room with MacDonald implied she went there to have sex with him. Which is why the jury found him not guilty. If Evans had walked in with her and MacDonald arm in arm they may well have found him not guilty as well. He was no where to be seen in that footage. He lied to get the key which he admitted in his trial because of their policy on multi-occupancy and sneaked out. The jury would have heard his reasons and decided whether they believed him or not.
Oh right so the new advice is ensure that there's CCTV footage of you arriving with the person you have sex with otherwise you're a potential rapist. Brilliant
I won't get into the debate about whether he is guilty or innocent as he was found guilty, if it gets overturned fair enough. However i fail to see why a club can't sign him. He went to prison served his time and he is now out. If i was in League One and my team was struggling to score i would want us to sign Ched Evans, i would have no issue with him playing for my team at all.
Why would she risk her compensation by starting a civil action? Any competent solicitor would have told her that a civil action may affect any appeal by Evans. How many victims of violence launch civil proceedings after a successful conviction?
Sexual violence is any unwanted sexual act or activity. As she was deemed unable to have consented this is what it was. Why do blokes always think its worse if you're dragged into some bushes?
Don't forget that signed contract of consent. To be safe it would be best that minutes were taken. Just incase.
They have been proven wrong. It went to a review of grounds for appeal and now it is in the next stage of our process. What I fail to understand, DMD, is that folk cannot consider some aspects of this case seriously concerning as to how conclusions are reached and how, therefore a judge might guide a jury; I really don't know the answer but I am very uneasy about the process and thoroughly welcome the current review. I simply hope justice prevails. I am not too sure whether or not the girl cared less who ****ed her that night - it certainly didn't seem to bother her the next morning, did it?

Because it is. To the point that victims of violent and derogatory rape have spoken out in defence of Ched Evans and the fact this case has gone along way to trivialise rape. The 'rape is rape' stance is complete and utter bullshit. You tell that to someone who was brutally victimised and humiliated that her ordeal was no different t someone who drank way to much and woke up with a hazy memory. Or to those women found in America last year. You tell them its all the same.
