    There has always been something unusual about the Toby deal. He said on arrival that Atletico could recall him. The press jumped on this at a press conference. Ronald had to say that they couldn't call him back until the end of the season. Now it is possible that at that point, RK didn't know the full details, but does imply they can call him back at the end of the season. It is likely that negotiations would start if Toby wants to stay and we may have to pay more or he may be recalled by Atletico and then sold to a higher bidder. Toby is not an observer in this...what he wants will influence the outcome.

    Atletico could always have held out for more for him anyway - loads of clubs were interested. Guess no one was willing to pay, though, given his lack of playing time for them. Now he's fit and proven across three European leagues, where he is has won a title or more in each: here's hoping that continues! We are always likely to be a victim of our own success in these situations.

    By time Miranda retires Gimenez will be 22, if he continues how he has been, he will be a good defender. I can't see them keeping Toby.

    Well, football fans generally don't. Which is why us lot here would be a lot more wise if we just ignored 90% of the crap that is written on blogs and articles. I understand if that is impossible. Supporters read an article and immediately want to have it cross-examined, dissected and verified by their co-supporters. I read quite a few articles myself and I don't link them here because they're only written to cause mischief. Eventually I find others have posted the link here anyway, so it gets talked about.

    I'll happily link positive rubbish here because I always want to put a smile on people's faces, but I know most of those are rubbish as well. 99% of the players-linked-to-Saints articles are bull. So much so that I can barely give an opinion on them half the time.

    Piece saying that Atletico can pull out of letting us have Toby by paying us 1.2 million. headline a bit misleading...how can it be a blow if it is in the contract and we know about it. If Toby wants to stay I'm sure something can be thrashed out, so it comes down to what he wants, what else is in the offing and how far we will go to get him.

    I assume there is no way our terms have some kind of clause meaning if they pay this 1.2m to force us away that they can't then sell to someone else for a higher fee. I would hope there is something that means the 1.2m buyout is specifically if they want to keep him themselves. Counter to this is that it could be after the payoff his contract is once again theirs to do as they like with

    Otherwise it seems like there would have been no point to arranging a few because all it would take is for his value to raise by more than the buyout and we would be screwed over in the deal

    Perhaps the deal is even more complicated that we realise...

    It all sounds so strange to me. A contract that says you can loan the player for a season and if you want to keep him you pay us 6m euros and he's yours.........unless we change our mind.......then he's not..........but we'll give you 1.2m euros for messing you about. who does contracts like that?

    Its far from the Suarez 'agreement' which was supposedly verbal and I assume Morgan's 'understanding' was also a verbal thing.

    Yes I know you can have a verbal contract and it can be enforced by law BUT at these amounts of money a verbal contract is going to be very hard to enforce once lawyers get in and pull it apart.

    Who said this agreement is verbal. You can put anything into a written contract if you want to. It's not even complicated...we have first dibs, but only if they agree. If they don't agree, we get compo for our troubles. This may be because we took over all his wages, rather than splitting it between us and Atletico. If we don't get him, they cough up their share of his wages.

    Yeah, hard for me to see that as "a blow."

    Someone has to outbid us by at least 1.2m to obtain Alderweireld. In which case the worst case scenario is that we get Alderweireld for a season plus got paid 1.2 million. Sign me up for that every time.

    Guessing that it's either a buyout of that clause, or an effective refund of a loan fee.

    Atletico may ultimately be able to leverage more money out of us as a result, by threatening to pull him back and put him up for auction, but even at double that fee it'd be reasonable.

    Maybe I am mistaken.......surely all the loans we bought in had "options to buy" clauses in their loan contract with agreed fees?
    Or was I dreaming that?

    I know football exists in its own bubble but you would have to think that athletico reneging on a deal and agreed fee to create an auction may give them negative goodwill when it comes to their future dealings with other clubs. And they don't exactly have the cash that means they can bridge that gap by spending.

    No one likes to negotiate with someone who will mess you around.

    But maybe I am just trying to be overly postive

    I would have thought the spirit of the agreement is for them to pay us comp If they want to keep him not if they choose to sell him to someone else. And I would like to believe there is something in the contract to reflect this (but that seems very unlikely)

    Isn't really a hard-and-fast agreement to sell if there is a mutually agreed-upon out clause. As he's still their player, they're well within their rights to exercise that out (if this article is correct), and then either keep him or peddle him to the highest bidder.

    Right from the beginning there was something different between the Bertrand and Toby deals i.e. Bertrand is more certain to stay than Toby...that doesn't mean of course that they won't both stay. We will just spend more time negotiating for Alderweireld.

    One thing I would say is that under Law of contract (not sure which jurisdiction the contract would be under) but a contract has to have the chance to succeed. If Atletico reject our bid just to accept another club's, then it is highly likely that it would be a breach of contract. I refer you all to the Ted McDougall case where Man Utd bought him from Bournemouth with certain clauses inserted into the contract which they never allowed to come to fruition. Would be an interesting sub-plot if we did want to buy him and Atletico wanted to cash in elsewhwrre
