O/T US Immigration

    Evening everybody,

    I am feeling the need to get away for a break at the moment and would ideally like to take my daughter to Florida for a couple of weeks. The problem I have is, I do have a police caution for cannabis. Do I declare this?

    I've been trawling internet forums for peoples opinions who might have been in a similar position to myself, what the general consensus seems to be is that if I declare my police caution then I will need to go to the US embassy in London and basically plead my case for a visa to enter the US. The US also seem to be extremely tough with their stance on drugs and it will be a toss up if I'm allowed in or not, especially with the caution only being in the last few years. Now, on the other hand, apparently the US will not know what the US cannot see. A lot of people on these forums, actually it seems to be the vast majority, simply lied about ever having involvement with the police, smiled and walked on through with no problems.

    Does anybody have any opinions on what I should do? I'm going out of my mind with worry about actually getting there, the bairn being so excited and then we get turned around and sent back.

    Is your caution showing on your CRB(Criminal Records Bureau) check? If you had one done? Either way if you can produce a clean CRB check in writing it should help your cause surely. If it does show on your CRB then you will have to declare it as your caution will be too recent. I think

    I'll need to double check it Bri, but, i'm certain I've read it somewhere that a caution will not show up on a CRB check as they are spent as soon as the police issue them now.

    What would show though on the check, would circumstances about how I was arrested be on there? It wont look good if it shows I was caught with it during a police raid on my home <laugh>


    Im really thinking about just blagging it, do people think I will be ok doing this?

    Na man, they read like an itemised phone bill, it will show your conviction type, what is was for, the date you got it and if it's spent, which it is, the date it was spent. no case details. Even though it's spent marra it does show on your record for a number of years. Can't remember how long, but not as long as any conviction gained through a court.

    I'm also hearing the US will only see information about me if they request it... its getting more promising,

    Come clean, there's to much scrutiny now with this IS **** and Muslim merriment. Go the other way into europe, I recommend Barcelona, Berlin and Amsterdam, if you are lucky then Roger will show you around..<ok>

    I visit Holland a lot so i'm pretty familiar making my way around now. I was supposed to be going at the end of this month actually but the f**ing dragon is going instead.

    The holiday was more for the bairn to be honest Joe, would love to take her to Disneyland, Sea World, Busch Park, Universal studios etc... I think its a once in a lifetime experience for kids and I was fortunate enough to go as a kid when my mother took me, would take great pride in passing it on to my bairn. Its going to have to be Paris Disneyland if its not the US.

    Unless anybody can recommend somewhere else I could take a 10 year old but I don't really want to be going to Spain, Greece etc.

    Stay schtum mate.

    Pretty sure they can only access serious criminal records.
    If you make an enquiry to the US embassy you are THEN on their records.
    They will let in Mass Murderers who are there politically, but mickey mouse admitted cautions and they will do all they can to keep you out.

    Did a search for my mate years ago lots of conflicting information, when he wanted to go to California with family.
    Same thing he only had a caution.
    He kept his gob shut and all was well.
    Took me a while to find it, but this is what he relied on. But saying that the info could be out dated now.

    There's Meli Park (spelling) just outside of Salou in Spain that is supposed to be their Disney World after they lost the bid to Paris.

    Google it mate and see where you get <ok>.. Whatever the outcome, sorry to hear about your state of affairs, you are a cracking lad, stay strong, sound & safe..

    Excellent mate, this is generally the information I have been led to believe. Seems as long as I don't get pulled up and questioned (can't see why when there's just me and my daughter) then everything SHOULD be ok.

    I feel like just falling to pieces, every single day is a terrible struggle at the moment. What can I do though, I've got a little girl who's about to lose her Granny who she absolutely worships. We haven't got a big family so it's just going to be us soon, I need to be strong for her. 31 and I'm soon to be head of the family, I can't get my head around it, it terrifies me, to be honest.

    FFS! Don't take it as gospel mate.
    But if I was in your shoes, I would take the chance and if they boot you, do like Joe says and transfer your plans to Spain.
    The mate I mention had a back up plan involving a campsite south of France.

    As to thanks, mean't every word, some great lads on here deserve better than what life has handed them. <ok>

    US is all dealt with via ESTA now, and usually if there's an issue it won't be flagged.

    It's $14 and lasts 2 years https://esta.cbp.dhs.gov/esta/

    I know many people who've had a bit of bother get into the US no problem, it's a myth that they check all visitors, it's a tiny percentage.

    I've been to the US twice, and didn't apply for a visa.

    You're supposed to apply for a visa if you have a criminal record, and even if you've been charged and acquitted, and indeed even if you've ever been arrested with no charges brought.

    How many of these three applied to me? I think you can guess :emoticon-0105-wink:

    I got into the US no problem. They only do a full check with a tiny minority of visitors. There's a miniscule chance of them hassling someone entering the country with a young child.

    This ^ my bro-in-law cannot go back to the u.s as he has an outstanding speeding fine on a jetski, the way i see it, if you've got a uk fine/conviction for a bit smoke you'll be fine.

    Just spoke to the wife and she says you're ****ed marra its part of the esta visa, she not 100% if they check everyone, she says dont disclose but book nothing until you have your esta visa

    You got into the US without a visa?

    There isn't a nationality on the planet allowed into the US without a visa mate, I know they used to do them on the plane up until about 5 years back, but no ESTA, no entry, you'd not get through the airport.

    Intrigued as to how you managed this?

    Said this mate, it usually comes back within 48hrs max and if that's ok, you're ok. Simple as that.
