If it goes soft when it is out of date it is a biscuit, if it goes hard, it is a cake. Lets not get into McVities taking a giant jaffa cake to court to prove it was a cake so they didn't need to pat VAT on it, as chocolate biscuits are a luxury item, or weren't you even going there?!
