Thanks, mate. Elsewhere, I have read that Cellino's paperwork for approval to be a director was only submitted on March 19th. If so, cannot blame the FL for the timing can one?
Just seen this on another forum: 1.1 "On19th March 2014, an Owners' and Directors' Declaration form was submitted to The Football League, signed by Mr Massimo Cellino on his own behalf and by Mr David Haigh on behalf of leeds United Football Club (LUFC), affirming that Mr Cellino is not subject to any 'Disqualifying Condition' that would disqualify him from acting as a Club Director (as those terms are defined in the OAD test) of LUFC." 1.2 Rule 2.2 (b) of the OAD Test requires the League to confirm, within five working days of receipt of such Declaration, whether or not it accepts that affirmation. However, both LUFC and Mr Cellino have asked that the League makes it's decision as quickly as possible, on the basis that 'time is of the essence' Looks like it may come from the FL website.
Yes. Why anyone (apart from Haigh, Nooruddin and GFH themselves, surprise surprise) was willing to accept an ownership structure that made that snake CEO is beyond me.
To be honest I'm not surprised. Cellino is a bit of a crook but not as much as Bates. What a joke for them to take this long in making a decision. Will be interesting to see who's going to table a bid now.
Wow, so does this mean that if Cellino and Haigh had pulled their fingers out and got that form to the FL a few weeks ago they would have been obliged to give a decision before the Italian court ruling ? In which case, presumably the FL would not have had any cause to block the takeover.
I think so WW. also - the FL are still waiting for an answer from GFH as to why Noorudin's company has been removed from the ownership statement - a question put to them over 3 weeks ago
According to that quote, they're only obliged to say they've received the application. There looks to be no time limit given for the decision.
That's not the way I read it. According to that statement, Cellino/Haigh submitted a declaration on the 19th, affirming that Cellino is not subject to any disqualifying condition. It is part of the FL's own rules that they will confirm whether they accept that affirmation within 5 days of receiving it. Seems to be that Cellino shot himself in the foot and has no-one to blame but himself.
Aye, I can see what you're saying, but in that instance they'd be able to simply reject it on the grounds of the impending court case. I'd guess then it would be a case of the applicant appealing. To do otherwise would leave you in a worse position, as you could end up with someone knowing they're due to be made bankrupt running your club with no fear of the consequences.
ONE to blame GFH Nobody else, we can all say "if" but the bottom line is GFH have begged and borrowed off everyone they have made a shambles of the club. They have shown what a desperate bunch they are and everything has been handled by them unbelievably poorly
No, I don't buy that either. Cellino must have provided proof of funds and there was no chance of him going bankrupt over the yacht tax issue. The only thing that blocked the takeover was Cellino's "dishonesty" over the yacht tax issue and with regard to impending court cases, what if the case wasn't being heard for another 6 months ? Would the FL have been able to delay that long ? I'm not sure they'd be able to justify delaying indefinitely. I just think it's been one almighty cock-up by Cellino. If I was his lawyer I'd be seriously worried about my future employment prospects.
His legal advisers have truly screwed up recently. Time for us to move on. But will Cellino bring dummyoutofpram insolvency charges against us, like the others? Think we are in for a rocky ride. 3 points tomorrow should see us safe. None of bottom 4 getting anywhere near a point a game, all depends if we go into admin. Would prefer immediate relegation now with -10 or -15 now than a season long struggle in champ with -10 or -15 to then go down the following year
We're in a bit of trouble now lads. We can't really have a go at the Football League as by and by, they have made the correct decision (I did want the takeover to go through). I think what annoys me most is we will have to go through all of this crap again - another bid: long delay etc. And the focus won't be on the football. We (in my opinion) definitely need to keep Mcd now, I trust him as a good scout and finding good young players on the cheap. So to try and move forward, whilst probably having to sell our key players in the summer - I cannot think of anyone else I would prefer in charge.
Problem for me is I truly believe Mcdermott is useless and he won't be taking us anywhere but possibly down next season. So who would I replace him with?? There isn't anyone who is capable with the squad we have and no financial backing. On top of that we could not afford to pay him off and what manager would take the job when we have been turned into a bit of a joke under the last two sets of owners. Did anyone else see Gary Cooper on Sky Sports News? Glad he spoke out against GFH and never sat on the fence, I guess we will see a resurgence from LUST now as well.
