Hope someone has insider knowledge ,I got a letter from north tyneside council.StatingYou got a parking ticket on blah blah,you havent paid,Step daughter was the offender she emailed them said there wasnt a ticket on the car (she drives my car) allso stating she was the driver.No reply for ages ,got a letter from court saying because you still havent paid it is now a hundred and odd quid, we can come and take property.She signed the letter with a note stating that there wasnt a ticket she would pay the original fine she was the driver ect,they have sent the letter back saying I have to sign the document,is this a catch? if i sign it i'm then liable ,me being house/ car owner so the barstewards can come and claim anything they want off me as she owns f all !
Have you been sent all the information regarding the ticket ??? have you been sent an overdue statement regarding the ticket?? if you had emailed the council to disagree with anything, you would of been given a case number normally they have to provide you with proof that a ticket was issued to that vehicle (photo) they would of sent you the pics if you had replied or disagreed to the initial ticket or a statement if as you say that you never received a ticket,and you also emailed the council to that effect then also reply to the court letter ??? (are you sure it's a court letter??) stating the same, that your step daughter was the driver of the vehicle and no ticket was on the vehicle when your daughter returned to it that you emailed the council saying the same effect also if had there had been a ticket issued, you would of paid the fine. Request the photo evidence of the ticket issued. Provide evidence that contact had been made to the council by ways of email. Just because they say that a ticket was issued does not say that a mallicious person has not taken the ticket off and disposed of it I have witnessed several times- people taking tickets off theirs and other peoples vehicles and throwing them away you would need to say that although there may have been a ticket issued, you dispute the extra monies being charged as you have not received the information requested (copy of ticket and photo's) and have had no opportunity to appeal that ticket I have appealled 3 tickets in the last 2 years and won each one but the thing was, is to act fast and not hide from it otherwise it will esculate into bigger fines I'm not sure if you will get away with the initial ticket fine though good luck anyway
she isnt disputing the original fine its the extras ,allso why do they want me to sign?thats whats getting me
If she is not disputing the fine, did she pay for it straight away this should of stopped any futher action by the council you only get the extras if the fine is not paid when paying for fines always request a receipt.
I was under the impression that when a ticket is issued now that the enforcement officer takes a photo of the vehicle and ticketing, I have watched them do this where I live, the other aspect is that had they taken you to court you should have been notified before the hearing, is the further penalty notice a real court letter or just a demand dressed up to look like it. The councils and their sub contractors are doing this on a regular basis with what would appear to be seriously official documents, best thing to do is to get in tough with the relavent department and talk it through, the other thing is no disrespect to your step daughter but did she chuck the ticket and hope it would all go away, one of my nephews did this to his mother, real embarressment as she worked for the council!!
update -phoned the department that deals with f'in people off,got told your the car holder doesn't matter if she was driving your, responsible .EVEN IF THE CAR IS NICKED AND IT GETS A TICKET ,YOUR RESPONSIBLE! I LOVE THIS COUNTRY ME. MORE THAN FRANK LOVES CARPETS
I would very much doubt this is correct. If I was in your shoes I would be contacting the citizens advice to check this..I would also go down to the department in person as they think they can get away with murder when it is by letter or phone..
good advice from MrRAW.
