He was arrested immediately after the incident. Police routine in such cases is to drug test. Had there been any truth in the suggestion that he was taking cocaine he would have been charged. Personally I believe his defence. I would have twatted the tosser as well. Note the Magistrate did not disbelieve Austin, he simply said there was no evidence that the other guy threw the first punch. Austin appears to have thrown the last.
I'm not sure the police drug test but I would have thought that they would have searched him. Footballers do have regular drug tests though. The other guy need not throw the first punch for self defence - you can twat someone first in self defence if you genuinely believe that you, your family, your property are in peril. I think it was just that there were more witnesses who said that the victim didn't approach Austin in a threatening manner that caused him to be convicted
They do, believe me. Your point about self defence is actually the same as mine. Austin said self defence, there was no evidence that the bloke acted in a threatening manner. Charlie went after him because he'd taken a photo of him having a piss, which would probably be on You Tube now but for the court case. Charlie's mistake was saying self defence, he should have pleaded justifiable twatting. Funny thing is, if the guy had taken a picture of Charlies bird having a piss, and she'd twatted him, he would still be inside. So much for equality!
