The whole thing is such a mess and it seems that all parties are in some way culpable. Trying to apply punishment must risk entering a minefield of potential further problems. No wonder the FIA wanted to strike a deal without the tribunal!
That was for the test between Bahrain and Spain I think. Apparently they did a test last year with Massa, which should be investigated, especially if they used the 2011 car.

The FIA confirmed yesterday that the 2012 test with Massa was with a 2010 car. Mercedes claimed that in that test Ferrari did more than 1000km but I think the 1000km thing is something in Pirelli's contract, not the sporting regs.
They should ban the Pirelli tests next season in my opinion. With the in-season testing there's no need for them and they're open to corruption.

Joke - the sport is a disgrace! I think all the teams should just go testing now there is effectively no punishment! The FIA can't punish the teams differently for the same infringement or crime!
It took them two days to do nothing. Cue the other teams arranging illegal test sessions ASAP because it's worth sacrificing the young drivers' test for. Mercedes didn't even try to defend themselves.
