There were many police constables standing beside them, but not one arrest, nor even one spoken to. CONSISTENCY MY ARSE. Why is an offence to sing BOTB but ok to sing TBB? I know my answer. Bias. Secondly, the learned gents need to be reminded that HMRC THE QUEEN laid a wreath at the memorial in Dublin to commemorate the sacrifice of the BOTOB. Has she committed an offence? Do we still have institutional bigotry in Scotland? Has nothing changed since The Lord Queensferry interference in the Education Act Scotland 1872 which forced the catholic population to set up their own schools in the face of institutional sectarianism? I restrict my comments to BOTOB and find it incredible that any court could reach that decision. 1 the title of the song OLD brigade tells you that it is not the Provos or any other post Irish liberation movement. 2 the first verse also tells us 'twas long ago we faced the foe. By this logic, the President of the United States could offend people if he disembarked Airforce 1 and stood to THE STAR SPANGLED BANNER, a song commemorating the US fight for freedom from the British. HWO ridiculous would that be. 3 BOTOB actually reflects the regrets of a father at the death of so many. Hardly glorifying the Irish War of Independence. This judgement is an insult to e Irish diaspora on a global basis. I would really like to hear the Irish governments stance on a decision making it legal to be offended by a song about the Irish fighting for their freedom from the global oppressors of the time. Irish history is part of the English curriculum in history at GCSE level. Wonder why it is acceptable there, but not here, just like the denominational schools and the lack of sectarianism. Again Scotland shames itself, but this time it is part of the legal establishment which manages to do so. The court argued that someone may associate the Old Brigade with the paras of the Troubles. SO NOW SOMEONE CAN BE PROSECUTED BECAUSE OF ANOTHER PERSONS IGNORANCE, OR worse bigotry. Astonishing, just like Boruc being arrested for blessing himself or the seven decades of the sectarian employment policy. I really hope that this is appealed.

I'm not outwardly Irish Republican anymore (actually I had a long and very nice conversation on a plane from London this evening with a British soldier who served in my old estate in the 70's, in which we didn't really disagree with each other over anything at all) but I really don't think being outwardly Irish Republican should be illegal - in fact it is quite incredible that it can be criminalised. There should be room in a Democracy for the thoughts of people who don't have the same politics or ideology as yourself to be expressed in this kind of tame manner, even if you do find those politics repugnant.
The main thrust of my argument is that in modern day Scotland it is illegal to acknowledge by song the historical right of a country to fight for its own freedom from oppression. Wonder how these judges would feel if the whole scottish rugby team were arrested for singing Flower of Scotland at Twickers. ? Scandalous decision by the courts based on someone's bigotry and ignorance of historical context having greater right over someone else's right to acknowledge their forefathers fight for freedom. The decision reflects the warped perspective and thinking of these pillars of Scottish society. People of the Irish diaspora are second class citizens in Scotland to the extent that their right is subservient to the ignorant bigotry of half witted bigoted WASPS. Along with the permitted singing of the FAMINE SONG until the Irish government complained and the arrest of Boruc for blessing himself and the tolerance towards the seven decades of sectarian employment policy and the media advertising of jobs excluding RCs, this is not scotland 2013 it is more like Alabama 1960.
This is one of my fears over independence. For all the fighting between England, Irish Republicans and Loyalists, neither England nor Northern Ireland have outlawed singing...as far as I'm aware. Scotland pretty much has and I think its started with an ego trip and turned into a petty fatwa (spelling?) in the name of shortbread. Yes If a football club decide it shouldn't be sung at their ground then the club should deal with it.. eject the singers...halt the game until it stops If its being belted out in the streets I'm sure it may be "disturbing the peace"...but dawn raids? Come on...
I get what you are saying, and I'm not sure I'd care that much about making these songs illegal - I can say this though because I don't really care if some weegie mong sings for me 'to go home' or sings about being up to his knees in my blood, it makes it easier to spot the *****s and embarrasses your club. Those particular songs are crass and don't serve to do anything but try to antagonise someone else though - on the other hand it is possible to be outwardly Irish Republican, by singing the likes of the BOTOB, and not be trying to antagonise anyone else - since the song only really shows a political allegiance, and doesn't really refer to any other group than itself.
What' so ironic about this charade is that the whole sorry mess was perpetrated by the oppressed Celtic fans in their faux offence at words of songs, now the stick used to beat normally upstanding citizens of her Majesty's Britannic Isles for singing songs with bad words in them is being used against the same people who were championing this stupid law only 12 months ago, now we're being subjected to all this whaling and bleating, it' almost comical.
