    The FIA has been reported to have offered Mercedes a deal instead of going to the tribunal, toto and Ross turned it down.

    I'm reading that as Mercedes think they're in the clear, and the FIA want to save the embarrassment of that being the outcome of the tribunal. They'd have to actually take a look at themselves if that happened.

    As the case for the prosecution was set out, it was announced:
    - Although 'informal communications' took place between the FIA and Mercedes, the governing body did not receive an 'outlining' of when the test would happen or under what terms.

    - Mercedes requested permission to stage the test in a telephone call with Charlie Whiting, the FIA race director.
    - Upon receiving the request, Whiting took advice from the FIA's legal department who informed him the test would only be permissible if all the other teams were copied into the request and were provided with an equal opportunity to take part.
    - The FIA have also maintained that although Pirelli's commercial agreement with the governing body permits up to 1000km of testing with any of the teams, their contract also stipulates they are bound to the FIA's own Sporting Regulations as well.

    Here's that specific regulation in full:

    151. Breach of rules
    Any of the following offences in addition to any offences
    specifically referred to previously, shall be deemed to be a breach
    of these rules :
    c) Any fraudulent conduct or any act prejudicial to the
    interests of any competition or to the interests of motor
    sport generally.


    "It seems to rest on some communications with Charlie Whiting, the FIA's Race Director. What the FIA are saying is if those communications happened in writing, which they were not, that automatically has to be distributed to all the other teams and then all the other teams would have been in a position to say 'hang on, no, no no, we object to this test and we don't want it to happen'.

    "Then as the QC said in the hearing, history would have taken a very different course."

    I think they will get a race ban similar to what BAR were given in 2005. Brawn will walk but Mercedes will stay in the sport and Lewis will do what Jenson did and take up commentary temporarily. <ok>

    But would they ban them from Silverstone? Bernie wouldn't like Hamilton to be missing out, think of the $$$ he may loose... I mean think of the fans ;)

    It should be a simple case of right and wrong but for it to drag on like this its a case of who's the most wrong and how much can the others get away with it!

    And I still think it's completely the FIA's fault, they knew it was happening and did nothing about it.

    I don't think Bernie cares about Hamilton missing the British Grand Prix to be honest. He's never been in favor of Silverstone hosting the event and it's not like every fan there supports him. There are Ferrari and Red Bull fans too. If Lewis is there or not, there will still be a full house.

    These idiots are running motorsport around the world!

    So the moral of the story here is. If you are going to cheat, make sure you don't get caught.
