If they want to be Rangers, then they can be. Just not for the reasons they use. A continuation of the club on an existential level or some such thing. You'd think that would be enough for them but instead they want to impose bolloxology on everyone. There is a club at Ibrox they call Rangers. It is a different Rangers to that which their legends like Kenny Miller, Mo Johnson, Harry Hood and Dylan McGeough played for. If they want to pretend otherwise, that is their business. they just shouldn't expect anyone else to fall for it.
Problem is that Nimmo ruled that because the players were registered regardless of whether the registration was flawed, they did not gain an advantage. He based his judgement on the payments not being disclosed, but BEING LEGAL under the FTT. I agree that the UTT changes all of this, as they will have been paid ILLEGALLY, but I anticipate that since the SPL will not exist at that time we will be told, yes they did actually cheat, but no one exists now to strip the titles. Interesting that the SFA rule contradicted the FIFA rule. If they lose the UTT I suspect that UEFA may become involved as they cannot have clubs making illegal payments and retaining tHe ill gotten gains. If left in Scotland then nothing will be done, but if taken to UEFA then I expect titles and trophies will be removed. Problem is, how to UEFA become involved if rfc defunct lose the UTT?
Fiorentina case is totally different, as Italian civil law forbids the liquidation of a sports club and so any reference to them is void. Different countries with different laws. In Italy the club is protected, not in the UK, witness Gretna and third Lanark. Duff and phelps report to creditors on six occasions stated that the company IS the club, so did rangers own directors letter of resignation from the Plus Stock Exchange and did so on three occasions. FIFA review of the year reported twelve outstanding events and said that in Scotland rfc were liquidated and with them 140 years of history and trophies. UEFA rules forbid the transfer of memberships of national associations between footballing entities and so proving that SEVCO are a new club. This is why they cannot compete in Europe until they have three years of accounts. SEVCO A NOT the same club and the Fiorentina analogy cannot apply due to different civil laws in Italy. If such did apply, then Gretna and third Lanark could reform and walk into the third division. Greenâs got to be havinâ a LAUGH By JOHN HARTSON Last Updated: 02nd March 2013 25 CORRECT me if Iâm wrong but didnât Lord Nimmo Smith find Rangers guilty this week? Didnât the respected QC study the old clubâs use of EBTs and decide they were actually up to no good? He didnât strip them of the titles, to the relief of everyone associated with Ibrox. But he could have. And letâs be honest about it â he probably SHOULD have. Donât get me wrong, as far as Iâm concerned, the five championships lifted between 2000 and 2011 were won fair and square. And in my eyes the Rangers players did absolutely nothing wrong by signing the contracts with benefit trusts. Do me a favour. There isnât a footballer in the world who would turn his nose up at a tax avoidance deal worth hundreds of thousands of pounds. But Iâve got to be honest and say that the reaction from Charles Green to the ruling sticks in my throat. I like Green. He calls it as he sees it and has done a good job at Ibrox since taking over from Craig Whyte. But this idea that Rangers are owed apologies from anyone and everyone who demanded they be stripped of titles is a joke. You would think heâd realise Rangers have won a watch here. Theyâve been let off lightly with the fine which, by the way, will only be added to the pot of debt for the Oldco. Itâll never be paid. A fortune has been spent on the case with legal fees going through the roof. The general reaction to the decision was that Rangers won but thatâs not how I saw it. At the end of the day Lord Nimmo Smith ruled that Rangers DID break the rules. He just didnât think it was a crime worthy of taking titles. What was it he said, they âdidnât gain any sporting advantageâ which is why he only dished out a fine. To my mind his ruling and punishment contradicts itself but it seems to be the SPL rule book possibly stopped him from going heavier on Rangers. Iâd have thought theyâd realise that, accept theyâve been let off the hook, and move on. And thatâs what I thought was happening. I initially read quotes from Green early on the Thursday afternoon saying he wanted to draw a line under the affair. âGood responseâ, I thought to myself. âThatâs exactly what you should be sayingâ. But by tea time the Yorkshireman was in front of TV cameras and unable to stop himself from saying something to appeal to the punters. His demand for apologies will only rub non-Rangers fans up the wrong way. Not that heâll care about that of course. Listen, I want to stress this â the ex-Ibrox players who signed these deals did NOTHING wrong. It wasnât just their agents or financial advisers telling them the EBTs were all above board and kosher. It was Rangers, the club. I came close to signing for the club myself and had they offered to pay me a few hundred grand on the side Iâd have snatched their hand off. There isnât a player who wouldnât. In fact, Iâm sure itâs the sort of arrangement which still goes on at the big clubs in the UK and abroad. With the amount of cash swirling around the game in England there will be off-shore accounts all over the place. But as a club Rangers must have known there was a danger this could bite them on the backside years down the line. And thatâs exactly what happened. I just believe that if Lord Nimmo Smith did think they were at it then surely he would have been well within his rights to take their trophies. It would have been harsh on the players â wrong even â but that was the risk the club was willing to take and they would have been forced to accept full responsibility for that. Green said months ago he wasnât going to play ball with the commission or even recognise its decision. He seemed to forget about that as he celebrated. He must have been terrified on Thursday morning when the report was on its way, knowing the fallout would be huge. Ally McCoist and everyone else will tell you now they werenât ever worried the decision would go against them. Nonsense. Theyâd have been worried all right and no wonder. I just hope this outcome does draw a line under everything because the whole saga became so tiresome. I want to get back to the days when everyone talked about the football, purely and simply. Celtic 'surprised' by Rangers commission ruling Comments (314) Celtic have stated 'surprise' at the verdict reached by the Scottish Premier League-appointed commission on Rangers. "We are surprised by the parallel conclusion that no competitive advantage was gained from these arrangements," said a club statement. The commission fined the company that previously ran Rangers £250,000 for non-disclosure of payments . However, the judgement ruled that no sporting sanction, such as removing titles, should be applied. The Lord Nimmo Smith-chaired commission was set up to establish if Rangers had broken player SPL rules in relation to its Employee Benefits Trust scheme run between 2001 and 2011. "The implications of this verdict are for the Scottish football authorities to address since the rules breached were specifically intended to defend 'sporting integrity'," the statement continued. "We note yesterday's decision that Rangers FC has been found guilty of contravening the SPL rules on disclosure of payments over 11 years between 2000-2011. "The scale of this amounts to a deliberate non-disclosure of £47 million in payments to players and staff." Earlier, Celtic manager Neil Lennon was guarded over whether Rangers enjoyed a competitive advantage over alleged undisclosed payments. "I believe they were found guilty of paying £47m over 11 years in non-disclosed payments," Lennon said.
