Colo confirms he wants to leave in January

    Don't know much About law but surely the law would be on our side
    With his signed contract , guess its not straight forward.

    The law is that we can't make him play for us, but we can:

    a. prevent him playing for anyone else;

    b. claim damages (such as a replacement's wages) if he refused to play.

    We are in a strong position, unless he decides to simply stay and play badly. Somehow I don't see Colo doing that

    Colo situation is pretty simple for me. I would not allow him to leave prior to May regardless. Then if that really is his desire its for him and San Lorenzo to come up with a package we can accept. Clearly they cannot afford his market value. Nor can he afford or have any desire to buy out his contract. So we are going to have to bend a bit. Maybe they pay us a fee between the two of them (whatever they can afford) and we set up some feeder arrangement where we pick up some free Argentine talent (I look forward to a Milon Nunez or Fumaca type). I really dont know but whatever his personal situation is, its clearly not serious enough that he has to go immediately as he would have already gone.

    So he'll just have to lump it till May when hopefully we can work something out.

    Players Union might have something to say on the issue, whether that means anything I'm not entirely sure. The manager's association certainly seems like a waste of oxygen to me.

    Personally I think making San Lorenzo pay his worth over a set number of years with interest is a decent option. If they can never pay anything for him, they can get stuffed that's not how football works!

    Indeed. This whole sentimental angle is a crock of ****e. To hell with any of that bollocks, pay up or do one. As you say I don't mind if that is over a period of time or some other arrangement but there has to be something in it for us. That's football and business unfortunately for San Lorenzo/Colo/his bastard father.

    San Lorenzo is not the only football club in Argentina, if Colo wants to go back to Argentina for personal reasons
    ( which frankly seems like a complete crock ) then why not just advertise the fact that he is available for transfer to any Argentinian club that can afford his fee as determined by NUFC.
    We have seen how difficult it is to sign quality CB's in the current climate, and if Mbiwa does sign we can thank our lucky stars and some.
    We are not a charity and are not in a position to act like one, our PL status is very much on the line, that has to be the first consideration. For me it's a complete no brainer Colo has to stay, because we cannot replace him until the summer.
    Another reason for hoping Mbiwa signs is the possibility that Colo having a quality centre back pairing, may in some way make staying and betting his head down for the club, that much easier to contemplate.

    It annoys me really that Colo is making these noises now.
    We've every right to be pissed off at him cos he's effectively asking the club to write off several million pounds of asset value. Put it another way... if we don't receive his market value £6m+ we may not have the money to buy another player... a player which may make the difference between staying up or not.
    Irrespective of the human element in all of this we can't let a player effectively pick our pocket after we've paid him well over the years.
    If his departure is inevitable it has to be on our terms.
    The least I would want to see is us say.... look Colo.... you are worth at least £6m so pay us this money in instalments over, say 3 years and we will let you go.
    We could then use his £60k+ to get a comparable player in (although in reality we may have just signed that player).

    Just went on San Lortenzo's official twitter page (their website is undergoing renovations).

    Two clear statements that Colo won't be joining them because Newcastle have refused to release him. SL are now looking at other options
