The fact is that it would be highly unlikely to have someone convicted in a court of law with just eye witness evidence against them, and the same should apply in cases such as photographic evidence. For example, if people sitting in the vacinity of the accused were to testify that he was using racist language and gestures, then that would strengthen the case against him.

Like most on here I don't get racists at football clubs as the vast majority of said clubs have black or foreign players so basically you are being racist towards your own players. As for this muppet he will get banned, for how long will depend on the club as he will not have a high class lawyer to argue or cheat his way out of it. One thing I have noticed about this latest spate of "monkey gestures" towards black/coloured players they are all one person in the crowd and they all look the same when the cameraman has "managed luckily" to get that killer shot. Maybe I'm being suspicious here but, this lad doesn't seem the brightest and may have been coerced into something, doesn't make it an excuse though and a ban will be dished out.

Exactly.. One thing I have found in recent times though personal experience at work with staff and customers and many times on TV, is the "it's just because I'm black" bullshit. Now, Yes it's so wrong to use words/gestures as rasicm but just as bad to use it in defence.
