    Don't agree with the whats in bold, if so why didnt he straight up apologise none of this its cool in my country bs.

    As for the whole police thing maybe Evra didn't want Suarez to get a criminal record more just to get the point across that its not alright to call him a negerito or whatever he was supposed to have called him.

    Really not sure what Evra was supposed to have done wrong in this whole thing.

    Actually it isn't. It's only a criminal offence if you can prove it was racially motivated, which would have required the CPS to prove Suarez targeted Evra for racist abuse purely because he was black. Which was patently not the case - he targeted Evra for abuse cos Evra is a bit of a whiny ****! Same reason Terry was never going to be convicted in a million years.

    And remember that taking the thing to court does not result in a better process - in court it is determined by 12 people off the street. If the Suarez issue had been decided in Manchester Crown Court you could have ended up with a jury of a dozen die hard Utd fans and Suarez could have faced the death penalty! ;)

    Would only have got past a magistrate's court if Suarez had elected to go to crown court, and if that was the case it would have been in liverpool, where the 'crime' was committed. irrelevent anyway, there was never enough evidence to convict Suarez in a disciplinary hearing(well not a verdict that would have stood up to independent scrutiny, anyway) where the balance of probabilities was adopted and the assumption of innocence was conveniently ditched. The case had no chance of even getting to court, let alone securing a conviction, in a real court where reasonable doubt was the burden of proof and the accused was presumed innocent until proven guilt. Just where and how do you prove intent, and your star witness is proven to have lied under oath at a previous workplace inquiry into the case?

    Behave! <laugh> Even if Evra hadn't wanted it to go to court the CPS is honour bound to take the case on in the public interest if there is sufficient evidence. Remember, it wasn't Anto ferdinand who charged Terry.

    But for that a member of the public would have had to have witnessed it and then reported it to the police which never happened. Not really sure what you are trying to get at here.

    All the evidence of the case has been published on the internet. If the police or the CPS deem there's enough evidence there would have been a charge - doesn't need to be 'reported' to the police, certainly not by Evra, and Goulding is an officer of the court, he is professionally obliged to report any criminal act to the court unless he is defending a client.

    No there doesn't! What if you went up to someone with Downes and called them a 'mong' in private, that was secretly recorded by cctv? Besides which, I can think of gary neville a few years back who was charged by the FA and spoken to by the police even though there was not one complaint by any Liverpool fans.

    I think you may be confused about instances where racial abuse has been called to the attention of police and instances where a public order offence has occured and evidence of it is public. For instance, nobody had to 'complain' about the rioters last year for the police to trawl through cctv and other evidence to prosecute transgressors.

    I can only go by Suarez' comments about 'what goes on the pitch stays on the pitch' with regards to the issue. He was seemingly happy to let Evra's abuse and insults remain on the pitch, Evra wanted it to go further.

    I think what Evra did wrong is start the whole thing in the first place, then when he got some stick back he complained. But he didn't really understand what he was complaining about (by his own admission)!

    The whole thing could have been dealt with better by both sides imo. Liverpool and Suarez should have apologised for any offence caused when it became clear that Evra felt he had been intentionally abused. And Evra should have told the story as it was from the beginning, none of the 'he said it ten times...it is clear, it is on camera' nonsense that he came out with after the event, which was a lie and helped blow the whole thing out of proportion imo. Also, when it became clear that the word '******' was not used, Fergie and Evra should not have used that word when making the initial complaint, again imo and again something which aggravated the issue. <ok>

    Really, so if a person racially abuses another person but no the guy doesn't want to make a complaint nor does anyone else yet the incidents and its "facts" become public knowledge the police are obliged to charge the suspect?

    I don't pretend to know the ins and outs of the law i really have no intention of looking it up i just thought thats how it is.

    Not really the same thing as a riot either where public and private property is being damaged so the offenders are going to find themselves up agaisnt the state anyway.

    I am sure you have pointed out in the past that the intention or motivation behind a potentially racist comment lies with the recipient? If Evra felt he had been racially abused then it doesn't matter what Suarez meant according to the law you quoted in another thread, and I am sure using racially abusive language is a criminal offence.

    Anyway, the court may not always be a better process, but at least it has an infrastructure in place to deal with these things. The FA seemed to fumble their way through it and their procedures were a farce...not informing Liverpool's lawyers that a meeting had taken place between Evra and the FA a couple of days after the event, not informing the panel that said meeting had taken place, and not having the documented account of that meeting available to the panel or Liverpool after the hearing had started is one example of why the FA should not have dealt with this case due to their incompetence. If that had happened in court, it would be called 'withholding evidence' or something and would be seen by some as an attempt to pervert justice, yet it was deemed okay in this case, not good enough imo! <ok>

    b) the offence is motivated wholly or partly by hostility towards members of a racial or religious group based on their membership (or presumed membership) of that group."

    It is possible to be racist but not to commit a legal offence. That has to be in place to prevent people making bs accusations to the law if they were having an argument down the pub.

    Like you say, that would be the case if this happened in court. But ultimately it was just a football ban. If you applied the legal test to all the football cases then Keane would never have been banned for assaulting Haaland as he could have claimed he just made his autobiography up for publicity; Rio could never have been proved beyond reasonable doubt to have wilfully missed his drugs test; and the whole disciplinary system would collapse. It would be like the loophole lawyers for speeding tickets - buy a good enough lawyer and you'll find a procedural issue to get away with it.

    I understand Liverpool fans are aggrieved now your club has ended up on the wrong end of the system, but it's been **** for years, so it's not like Liverpool have been treated in any way differently from everyone else.

    Guys, why are you still arguing about something that ended when Suarez was found guilty and served his ban. They'll either shake hands or they won't. Who really cares. In light of the events of the last week or so, there are more important things to worry about surely.

    My cousin is a copper in Liverpool. they regulary prosecute people for domestic violence, even when their spouses back down. In fact, you can be done for contempt of court for withholding evidence. If there was enough evidence in the Suarez case to prosecute for aggrivated racial abuse, they would. mind you, there was enough evidence to prosecute Evra for threatening and abusive language, but they didn't do that either.
