This subject has been done to death, and anyone with anything worthwhile to post won't bother because of the mental patient that started this thread. You started your first 'deep' post with an insult, and you automatically think you're smart because you waffled ****loads with no end product/structure in your argument. The point of the hypothetical argument was to point out just how taxing the idea of killing criminals is. Guards aren't morally culpable for taking life, but contributing to a system of rehabilitation at best and confinement at worst, which cannot be argued as more or even equally "unethical" as taking life in the current climate (and to be honest I can't see this element changing). Preserving life over taking it is so ingrained into law and society we cannot take our own lives. The "eye for an eye" idea is basically my interpretation of what you call "justice". Justice is about the right thing being done. To me, in line with point one of this post, attempted rehabilitation is more desirable and more "right" than taking someone's life. Wanting someone dead for hurting you or your family is perhaps instinctive, but is led by one of two thoughts, revenge or fear. Fear that the criminal may kill etc again, or wanting to avenge a lost life, are both held as irrational arguments and don't really pertain to a definition of justice. Making criminals serve time, however, puts some emphasis on rehabilitation and can be argued as more mentally healthy (for the victim/family) for the purposes of moving on because it involves rationally accepting our ideals of preserving life above personal loss. Obviously this perspective is heavily influenced by my non-religious outlook, and there can be many different interpretations of the situation. Then again I don't claim to have the all defining answer on the subject. What I will add is that I disagree with the lengths of the prison sentences for the purposes of confinement and rehab, because they seem(/are portrayed as) disproportionate to the crime (or what the general public hold as "rightful" anyway), and in my opinion this fuels more extreme conjecture about the death penalty as a solution.
Probably explains why the rape conviction rate is so low. That and the fact that the 'victims' are usually gagging for it
