http://www.uhy-uk.com/assets/media/download/turnaround-and-recovery/PFC CVA 28th May Final2.pdf PAGES 79 - 87, contains details of the unsecured creditors in 2010. On a related note, I am both shocked and disappointed to find out that not only were the creditors of the original (failed) CVA not invited to vote on the new CVA, but also that our administrator doesn't have any of the contact information for them! Surely as administrator that is something he should have details on? Furthermore, surely he knew that giving the creditors from 2010 an opportunity to vote on the new CVA would be crucial, so why didn't he invite them to the CVA meeting? This is at best incompetence; at worst dishonest, as perhaps it was done as he knew they wouldn't have voted in favour? I feel completely let down that our future has been gambled in such a callous manner by Mr Birch, and that we have now suffered a points deduction which is looking highly unlikely to be overturned because our administrator has failed to do his job properly. I feel incredibly sorry for the fantastic man that is Michael Appleton! He has had to put up with so much rubbish since joining our club, and every time it looks like we are turning a corner, he has to face further set backs and obstacles to him doing his job. And yet through it all, he has stuck by us, and I hope he realises just how much all us fans are grateful towards him. I just pray that the sale of our club goes through ASAP, the football league release the shackles placed on Appleton in regards to player recruitment, and that our dishonest/incompetent administrator leaves the club in a better state than he found it, although if things continue the way they are at the moment, I fear that liquidation may indeed be a much more realistic threat than first feared! MICHAEL APPLETON'S BLUE AND WHITE ARMY!!! POMPEY TIL I DIE!
That is the list on a specific day. There is nothing to say creditors have not come forward since or been discounted by Baker Tilly This CVA is for creditors of PFC 2012 PLC and by law only those can vote on it. Those from 2010 are creditors of Portsmouth City Football Club Ltd See previous answers - that is Baker Tilly's job See above, the law says he couldn't No, see above, as an officer of the court he must follow the law See above Fair comment Probably defamation. Still the most likely outcome
I wouldn't be suprised if I don't get one. But, I've done what was asked on the website (sent info RE: 2010 creditors) and at the same time managed to vent some of my frustrations at this awful situation we have found ourselves in.
I very much doubt you'll get a reply. I like the fact my question about why the creditors from 2010 weren't included in the meeting was included
I feel like we are................. in the Star Trek holodeck with the safety protocols switched off, and instead of just playing the role we signed up for, ie being the supporters of a football club we have become the unwitting victims of a satirical farce being played out by the Romulans versus the Klingons. Because this sure as hell can't be real life. Am I here? Or am I really just nuts and in St James's being treated for delusional hallucinations?
One question - whether anyone knows the answer............ Did Trevor Birch hold the meeting for the new CVA in the correct way to meet the conditions of insolvency laws and it's the FL who's rules are different, or did he not meet the conditions of insolvency laws?
I don't fully understand, I'm more of a Doctor Who guy myself O I get the gist of it though Eventually one day the good ship Pompey will sail in to calmer waters...
Nah it's fine, your message may have lost some of it's 'edge' if you were seen to be quoting a guy named after a Pokemon! Er..... my thoughts exactly
I think you are being harsh on Birch. As for your "dishonest/incompetent" comment Ummmmm!. I would keep an eye on your mailbox if I were you (that is if you had the courage to supply your address), I have a feeling you may hear more. I know if I had received your mail that you most certainly would. Suggest you chill out.
Chill Out? Are you having a laugh...... ......living in Thailand and with it being only your 6th post, I think we can assume that you have not got the first idea of wha has happened to our club over the last 3 years have you?
Surely there's more important things to do at the moment than trying to overturn a ten point deduction?
Even if there was a legitimate case to be put forward on Pompey's behalf to argue against the points deduction it would not matter. The Football League do not retract such decisions. They refused to do so for Southampton a few years back, and the uncompromising stance they took with Luton back when they docked them 30 point before the first games of the season is more than enough to prove that the Football League cannot be negotiated with and will not back down. As such we will get no where by arguing against this, we just have to accept it, move forward and do the best we can within the restrictions placed upon us.
Reading between the lines, a bit, it seems that TB is trying to keep Chanrai's bid in the frame. Still no word from the PST - when is the 28 days (from the CVA vote) up? It must be within days now surely.
