I still believe JT will get banned by the FA

    For what it's worth I'm quite sure JT will be found not guilty by court of law but equally as certain he will be found guilty by the FA. I'm pretty sure the FA said they will conduct their own investigation anyway. With Suarez banned, I don't see any alternative. The precedent has been set.

    I also think the FA will look at the fixtures and we are scheduled to play QPR in (September?) try to avoid the whole media circus and drag JT out the firing line. I reckon he'll get 8 games, probably reduced to 6 upon appeal.

    Before people jump the gun I'm not saying he deserves to be banned (if found not gulity) just give my tuppence worth on what will happen.

    I disagree TBH.

    The FA have completely bottled doing anything themselves and have hid behind the Courts on this one. The time to conduct their own investigation has passed. They either should have done it at the time when the initial issue arose or (upon the court hearing being listed after the Euros) before taking away the captaincy.

    When they realised the hearing was going to be after the Euro's they immediately took away the captaincy without bothering to undertake their own investigation. So if the Court's find Terry innocent, really can't see them conducting an investigation that might then contradict the Court's findings. If he's deemed innocent I fully believe the fa will follow suit and do nothing. If Terry's guilty, they will conduct their own 5 minute investigation and ban him; probably for 8 games.

    I cant possibly see how the FA can do that! Going against a court judgement will make them appear ridiculous, on top of the fact that if they had any intention of doing so they should have done it at the time! The CFC board I am sure would not take such an action lying down!

    I agree that they won't ban him if he's found not guilty. However losing the captaincy was the minimum he should've expected when he was charged and then delayed court proceedings. If you were charged for racially abusing someone your work would be well within their rights to suspend you and in some professions you'd have to resign. If 'Arry could go to court midseason there's no reason Terry couldn't so it's his own fault, although I feel the FA should have clarified that he could no longer captain England until he cleared his name.

    It's about time the FA were in Court charged with offences against mankind, ie Taking valuable oxygen that could be better used by mankind.

    It's because the FA work more on a balance of probabilities in their investigations, much like civil court, whereas the criminal court he's in at the moment requires proof of guilt beyond reasonable doubt. The lower probability of guilt required makes it possible for the FA to still find him guilty, just as criminal cases can be brought to civil courts under slightly different laws and end in a different resolution. Also the FA's definition of what is unacceptable is different to criminal law means that he could be not guilty and still be punished by the FA. I can't think of one occassion where the FA haven't taken the easy way out though so it probably won't happen.

    As for the other bit, the FA couldn't have made their decision before as it would risk influencing the trial.

    The FA wont take context into account as the court did bm2.

    JT has admitted using the words(in a rhetorical way), but the fact that he did say the words during a match will give the FA enough rope to hang him.

    As pointed out by the OP the FA made a precedent when they punished Suarez.

    Wasn't the overall point with Suarez is that he tried to argue that Negrito (or whatever the spanish word was) is often used as a term of inderement in some countries? However it was clear he wasn't using it in that context when having a barny with Evra.

    Terry's case is that he says 'I didn't call you a black...' or words to that effect. I think there is a distinct difference there.

    The FA pointed out that 'context' is not an excuse in this country,also wasn't JT(like suarez)having a barney when he uttered the offending words?

    And as actually saying the words in any context on the field of play is against FA's fight against racism in the game they've got him by the short and curlies.

    But it's a wait and see because we know the FA make rules on most things up as they go along.

    It's entirely different. If Terry's story is correct he's merely repeating the words Anton Ferdinand said, where as Suarez admitted(eventually) to using the term to Evra. Suarez claimed what he said was not offensive in Uruguay, which didn't stack up, and was banned. Whether the context mattered was the argument but he was given the ban because he called Evra by a racist term on the pitch which broke the rule in itself. If what Terry's said is true he didn't call anyone by a racist term so has broken no rules.

    im not sure its all that different.

    Suarez's story - I said in a friendly and consolatory way to evra word that i use with my black friends.
    Evra's story - he aggresively and antagonisingly attacked me using a racist word.

    I believe that had the fa reached the verdict that suarez was geuinely speaking in a playful and friendly way they would have given him a slap on the wrist. Point is 'by the balance of proabability' he wasnt - so it counted as racial abuse. The key point here is that the use of the word negrito in itself was not considered racist as an absolute, hence bringing in the south american spanish speakers and interpraters to ascertain he context in which it was meant. the context, and the probability of its context, was what determined Suarez's guilt.

    Terry's story - I repeated the words that Ferdinand had used back to him.
    Case for the offense - you used the words yourself in reactoin having been attacked about your past and in doing so racially abused somebody.

    Again the context is important. If the courts cant prove beyond reasonable doubt, but they can prove by the balance of probability, that Terry's story is a fabrication and that he did mean to use his words in an offensive way, then I think he will be treated exactly as suarez was.
