Disclosure

Any of you bawbags needed to have a disclosure scotland check done? My friend needs an enhanced one and was wondering something. He was arrested for breach of the peace but wasn't convicted. He was charged £75 for breach of the peace and resisting arrest, but told if he paid it, then he wouldn't have a conviction. Would this show up on my, I mean his enhanced disclosure check?

 

you might get lucky and the gov might bin this law along with few other, and you/he wait a couple of months?

 

It was sent away yesterday LR I was looking at the website for him and it doesn't mention arrests without convictions. It mentions cautions but he doesn't think it was even a caution because he didn't get the chance to refuse it. At least he doesn't remember, he was very drunk when it happened.

The coppers broke his wrist as well, which is why I think there was no conviction. Instead of taking him across to court in the morning, they had to take him to hospital

 

it depends on the level of disclosure

if you need the highest level then it will probably show up that you were arrested.

 

Hope I never need that level. I was found Not Guilty of Aggravated Assault and Uttering Racial Remarks.

 

the £75 was a bribe not a fine

 

if your found not guilty then it means you didnt do it.

 

I don't think it shows up if you were just arrested though. It says cautions and convictions, but for a caution they need to inform you and you are allowed to refuse it. He didn't get anything like this.

got arrested for assault but released due to lack of evidence, would that show up?

for the record all i did was take a punch like a hero.

Spot on Dougie. I got arrested for **** all. Got a kicking and thrown in a cell over night. The Police were further more helpful when the said that my fine would go away if I paid £75.
At least if I went to a hotel I would have got breakfast for that!!!

 

it just means the court accepts that you meant it in a hilarious way which, at the time, was taken out of context

 

I never racially abused him they claimed I said "Throw the ****** a bone" when I actually said "**** this, I'm going home".....I did spit in his face though.

I didn't do anything wrong though. Broke up a fight between two groups of my mates and told the coppers it was fine and everyone was going their separate ways. I turned to walk away and they jumped on me. I landed on my wrist and it snapped, so pulled it under my body instinctively. That was the resisting arrest. Spent the night in the slammer and in the morning they came with breakfast. The bird was almost sick when she seen my hand bent back almost touching my elbow She even dropped my breakfast

 

I've no failed yet the disclosure comes back in 4 weeks. Even if it does have it on, I'm sure I can get away with it
