    Think the "assault during the course of a job" has to be taken in context, SB. A fight in a rugby scrum wouldn't be dismissable on its own. I doubt they had any lawyer telling them they could sack Joey and not face an action for serious damages, and worse, reinstatement. Highly expensive, distracting and time wasting for management, and leaves a bad taste in the mouth within the club. If Joey's prepared to hold his hand up and take his punishment on the chin, I can see why they reached a compromise. And they have set Joey up for a quick and cheap exit if he misbehaves again. Personally, can't criticise management over this one...

    SB/FFS I believe it's been handled in another thread some weeks ago, where the conclusion was that football isn't comparable to standard English employment law. I might be wrong and in that case I'll easily back down. As to our two lovely countries, our laws are founded on the same principles and I believe you'll find them very similar. Everything a ok? :)

    No but those were 2 of the best players in the league, Barton is awful and grossly overpaid and worthless.

    But is it then fair to chastise him because he's not world class? Should the crime be based around waiting talent or simply not having any?

    We didn't see the best of him (barring a couple of games) but he does have talent and can affect a game very positively when he's on song.

    Its just the way it is, look at Tevez. Hed have been sacked if he was a reserve player or a player they wanted to get rid of.

    Sadly, I think you're wasting your time. If they could have sacked him they would have. They have taken the fair and equitable option and given Barton an unequivocal final warning, in other words they are doing it by the book. Give him enough rope and he'll hang himself. Better still, Big Sam will come knocking in November and a loan deal will lead to the exit door saving us millions...

    We all know that you are right Soops, but I do waste a lot of my time on Q.P.R., and I can't think of a better cause to waste it on.

    Like others on here, I have some limited understanding of employment law. Whilst I would have dearly loved (LOVED) Barton's contract to have been terminated, I suspect the club has done as much as they can in the circumstances. In fact, having reached a new agreement over any repetition of such behaviour, they have actually secured a useful lever should they need it in the future.

    Let's hold our breath and hope the stupid idiot doesn't damage us any more.

    Tony Fernandes is keeping out of this one and leaving it to his management team. He said as much when asked on interview in the days following the final match of the season.

    It would undermine those at the club who have worked hard on this process and have come out of it with a reasonably 'win-win' situation. No one has lost face too much thus far, a tricky balance to achieve.

    Exactly, they even got him to agree to a sacking should he cock up once more. Barton could have held firm and refused that. The club did everything possible short of getting rid of him and the only one who can do that is Barton by agreeing to it.

    On a related note, Id like barton to give his ~4weeks wages that he hasnt been fined but still suspended to the QPR community trust.
    After all, he says he doesnt care about money.

    Think the clyb were backed into a corner by a legal team.

    Did as much as they could & wouldn't expect him to be playing for us again anytime soon......

    I say let him train with the youth team and we'll keep our 11million to spend on some new players.......

    One of the papers said we tried to fine him 3 times as much but the hypocritical PFA stepped in, theres no way we could have done more.

    I'm pissed off that this is still not come to a proper conclusion. Yorkshire Hoopster is an employment lawyer, I'm inclined to take his view over anyone else's. I will not be attacking Norway anytime in the near future. Actually thinking of a summer break there - any advice mate?

    His opinion is worth as much as anyone elses unless he knows whats in Bartons contract. Perhaps the gross misconduct clauses only apply to off field behaviour?

    This seems to confirm it

    "QPR wanted to fine Joey Barton three months&#8217; rather than six weeks&#8217; wages for his violent outburst against Manchester City, the Daily Mirror say.

    The PFA are said to have stepped in to stop him being fined close to £1m by the club.

    Rangers are determined to ship Barton out of Loftus Road one way or another, the Daily Mail report, and manager Mark Hughes is likely to make him train with the reserves until the player leaves."
