While factually that may be correct, the same question remains - why sign a contract to sign a contract if you cannot enforce the contract that was signed to sign a contract?
This was always my understanding but 1) I thought they put special considerations to pompey considering they are in financial **** and need cash quickly. Therefore all players can be bought off them during whatever time they like. 2) Even if Pearce didn't want to stay/sign for leeds, its not really an option given the fact pompey have probably already spent the money we gave em to try and stay afloat. Its not really an option that either party (leeds or pearce) are able to consider
I think you are right, we managed to get Pearce because the league offered special consideration as Portsmouth needed the money now to survive, Pearce is a Leeds player. If it were a promise to sign we would not have handed the money over yet.
It says agreed with Pompey not paid to. Why do you think football clubs owe other clubs so much money? They dont always pay other clubs when they should. Therefore if this did go tits up and Pompey had already been paid and used the money then you would just have to wait to get your money back. Thats why the football league have brought in ffp to try and prevent this from happening
As I believe it and read somewhere but can't dig it up, Leeds and Portsmouth were granted permission by the FA due to Portsmouths financial situation and the ability for Leeds to hand the money over there and then, the funds have already been paid into Portsmouths bank account and the player has signed a contract, not an agreement to sign a contract.
Had a wee think about this, chaps. I have the funny feeling that all players are signed as freelance contractors (for tax reasons) - i.e. they do not receive a wage from LUFC, but payments to their own individual companies (often offshore, funnily enough). This means that the player contracts do not come under employment law, but contract law instead. Might be talking pish here, but genuinely think that's the situation & means that Pearce would be in breach if he walked.
Some are mixing up consumer rights when purchasing products with whatever law covers player contracts Once the contract has been signed, you have to honour it and there are special considerations for breaking it. In this case, Pearce has signed. If he was lied to, he may have a case to claim compensation or demand a transfer. Pompey as a innocent third party are not involved, registration is with leeds
