Just because she was my family member, doesn't mean I'd automatically take her side though.

If I heard that she went out drinking, not remembering what happened the next morning, with her clothes on the floor, I wouldn't automatically assume she'd been raped.

We're going to be defensive about our family members though.

I still think that for a sentence of only 5 years, something sounds **** about this case.

If we are to assume good evidence was presented, then how is 5 years for a rapist for a 19 year old girl justice?

5 ****ing years? People go away longer than that for armed robbery, even if no one gets hurt and the person was just holding a weapon up to someone and demanding money or w/e

It's a good question. If there's good evidence that someone has raped a young woman, then how can a competent judge only give the rapist 5 years?

There's only 1 thing worse you can do to someone than raping them, and that's taking their life.

5 years for rape is a **** sentence. It should be more.

If his sentence had been 20 years, then I'd most likely be less suspicious of this case. 5 years sounds like the jury and judge wasn't sure, but gave him a 5 year sentence just in case...

 

The sentencing guidelines are perverse in this country. Rapists - scum of the earth and they should lock them up and throw away the key. Instead if convicted they get ridiculously short sentences. Obviously I haven't heard all the evidence or read the official transcript of the case but it would make interesting reading just for the full facts. I normally don't buy anything the media reports and having read transcripts of similar cases the full evidence can be a real eye opener. From the sound of it though the victim as is becoming the norm unfortunately was off her face in which case if true she is a pretty stupid girl for getting into that state in the first place. Sadly, it will happen again because being in that state is apparently 'a good night'. That's a whole different argument though. Rape is rape at the end of the day and Ched Evans has been punished.

 

As I said mate, 5 years doesn't sound right. It should be a massive sentence or no sentence at all in this case.

If there's sufficient evidence to convict a rapist then it should be a harsh sentence. If there's not enough evidence, there's should be no sentence immediately.

I believe the court needs to be very sure before passing sentence, and a 5 year sentence and from what I've read from this, the court didn't seem very sure, if they were, there would be a harsher sentence.

 

Agree with you two on that one, the criminal system is shoddy. From personal experience I can tell you that scumbags get off to easily.

Very, very little proper evidence to give a sentence of rape on. To ruin his career and probably life by sentencing him as a rapist just because someone can't remember what happened one night is harsh in my opinion.

I'm not, of course, saying he didn't do anything wrong, but being given the same sentence as someone who pulled a girl into an alley on her walk home and forcefully had sex with her against her will seems wrong to me.

 

There's a lot of things wrong with the laws in this country. Like how someone who messes with kids effectively ruining their lives pretty much gets a ridiculously low sentence. Since it's the subject of rape, i reckon women (or men) who falsely accuse someone of rape should have the book thrown at them. Just an observation.

 

The general consencus amongst people in the public is that sentences are too light, yet when I worked at the Crown Prosecution Service, I was told by my boss there that they done a test one time and that the sentences were harsher than they were expecting.

 

I can understand not having life sentences, as everyone makes mistakes of varying degrees, but some of the light sentences are criminal, if you mind the pun. Completely agree with you about girls who cry wolf. I don't think they understand how much it screws someones life up to have a tag like that over you.

 

Also when they cry wolf it makes it that much more difficult for genuine victims to be believed.
