Interesting perspective, that the punishment in a knock out phase should be different to that dished out during regular season play.

Interesting stuff, and seems reasonable on all of the points of law. Unless I missed it though, what is conspicuous by its absence is what would happen after Southampton were expelled.

Are Middlesbrough awarded the semi-final, or are we awarded the final by default?

I’d infer the former to reinstate Middlesbrough’s position prior to the breach, but if that happens I don’t think we’re playing on Saturday and you’d have thousands if not tens of thousands of seats on coaches, hotel rooms etc wasted. That said the consequences for the fans of Hull City rather than the club itself are probably of no interest to a sporting judge.

I think if Southampton are expelled, we get promoted. Personally, I would hate to go up on a technicality but if it happens so be it.

I think based on the language and the Swindon case, Boro would be reinstated.

For me though, if they have been deemed to have systematically cheated (which may need further investigation), why should Boro be the only ones to benefit by reinstatement? What happens if Wrexham can prove they were spied upon (did some say Southampton beat them 5-1, which they could argue cost them a play off place)?
If they are looking at expulsion, I feel the final should go ahead as planned, allow some time for a deeper investigation and then if they have systematically spied, we take their place in the premier league, with their profit from the day split between those who could argue they may have lost out (only Boro and Wrexham?).
Seems fair to me!!!
 
If they’ve pled guilty, as is now being reported, to multiple counts (boro & at least one other).

Relegate them.

Seems fair. We're the only honest team to have won a playoff game, we should get the reward and Southampton get the punishment.

I’ve seen a lot of Boro supporters on X and their forum say ‘just send Hull up at this point’.

I imagine a lot of them, Steve Gibson included, would be somewhat miffed and disappointed that they couldn’t take Southampton’s place but I think they’d get over it a lot quickly than if Southampton were allowed to play in the final. If that happened, Boro definitely should get something out of it and Southampton need another sporting sanction for next season.
