I thought that I would be able to consider this ruling objectively. However, I am finding that practically impossible. Like the vast majority of posters, I totally agree with the principle that racism is just not acceptable from any direction and in any activity. However, from a logical/legal standpoint this FA decision appears to fly in the face of all legal precedents and the whole concept of common justice. You simply cannot penalise a man for saying something that another man finds insulting purely on the complainants interpretation. Everybody has the human right to be/feel offended - what they do not/should not have the right to do is seek retribution. This 'judgement' brands Suarez as a racist. The fact that Evra's written testimony is said to contain a statement that he does not think Suarez is a racist, the fact that the preamble to the FA's judgement is supposed to say the same thing is totally immaterial. If you charge and convict somebody of a criminal act they are deemed to be criminal - even if you say otherwise. The same logic applies here. Further, when the complainant admits to using a slur himself (in the language of the accused) no action appears to be proposed on the issue by the FA. Unless, the FA report can bring forward corroborative evidence on behalf of Evra's claim then the judgement is totally flawed as it can only be based upon opinion and not upon fact. The FA had better hope that Liverpool and Suarez take a pragmatic view and base their appeal on the basis of reducing rather than overturning the ban. However, if they chose to seek a judicial solution (ignoring the FA appeal process on the basis that the system has proved itself to be flawed) then we are in for a very prolonged action - the consequences of which are very unclear. Far too many people appear to have had a finger in this pie - either directly or indirectly. The decision itself has been tainted by the lobbying of interested groups - not least being those groups who concern themselves with racism both within and outside of football.
No he isn't - YOU are. If laws are to be observed then the have to be equal for all parties. It makes no difference that you are "paki" (your term not mine), the law cannot give you and greater or lesser rights than any "non-paki". If it did then it would be an inequitable law or is that what you really want? That is the point that Ze is making!

I've been out since 9pm., I've got back and waded through 200-odd posts and jeez, I hardly know where to begin. The idea that it must be true because the FA says so is extremely naive- they have shown themselves to be hypocrites before and to base conclusions on political convenience rather than justice. To have any credibility, they need to present the evidence in full and we all have to see that evidence before we make up our minds. Some things don't seem to sit right; they should not attach a racist tag to anyone unless they have incontrovertible evidence that they are right (and Eric, intent certainly is an important element here). So if they have this cast-iron proof, it does seem strange that the club have said they will appeal against it. An appeal under these circumstances is a very different thing than Kenny just giving vocal support to his player. The polarization of opinion on here is predictable, but blinkered. The repercussions of this decision will affect all in the English game deeply, and could lead to a rash of similar claims unless the decision can be seen to be open and fair. We all need to know more of the facts before lining up in the usual camps.

Ya it is 10 here so really late there. These dudes have no clue what racism is and I see every fan of every other team spouting we are blinkered etc etc. What proof, acutal PROOF, other than what Evra said and what Suarez said do they have? Was it in the ref report during the game? Did the other players hear it? If not it is what Evra said vs what Suarez said on Uruguayan tele. That is not clear and concise evidence. If this is, then why is JT not getting banned when his is apparently caught on camera. Again this isn't racism, look up what Samuel Eto'o used to deal with, I think there was a ghanian at Sienna who did the same, almost walked off the field. The entire Nou Camp back when seedorf played for Real ALL chanted " o o o o o" throwing bananas and making monkey jestures. That is racism this seems more of a he said she said or they took it the wrong way. I am not being blind to this, I think this is more of a case of dislike than racism.

Ermm re-read my post, I never said he was innocent and in previous threads have said he should be punished if the evidence is irrefutable. At the moment it is not just irrefutable but non-existent. My caution was meant to remind people that there have been numerous people found guilty of all crimes with much more scientific and seemilngly damning evidence than we have seen in this case, and those have been in real courts before a full jury!

Mate you are the voice of reason and I applaud you! In the coming days we may find out what evidence exists that led the FA to their decision! I hope that whatever evidence is uncovered that certain posters who have took a side one way or the other will be big enough to say they were wrong, I doubt they will however it is much more likely that they will not be seen on the Liverpool forum again!
