More madness from the Sentencing Council The Council has drafted new instructions to judges on how to sentence immigration offenders. Their guidelines would mean hundreds of foreign offenders and illegal migrants a year would avoid deportation, blowing a hole in border enforcement. The Government has a duty to remove non-Brits who have been sentenced to 12 months imprisonment. But for a whole range of immigration offences - including deception, entering illegally, and possession of false identity documents - the Council envisage scenarios where judges should hand down sentences shorter than 12 months. Their draft guidelines would even give a ‘first offence’ sentencing discount to *immigration offenders*. That is nonsensical. Until now the Sentencing Council has not issued instructions for immigration offences. But now they are veering into the territory with soft sentence guidelines that undermine border security. The most egregious example is their draft guidelines for facilitation offences (meaning assisting illegal entry on small boat or vehicle; harbouring an illegal entrant; or procuring false documents). Under the Nationality and Borders Act the statutory maximum for the most serious acts of facilitation is life imprisonment because of its incredibly serious nature. However, the Sentencing Council has significantly watered this down, recommending a custody range of just 10-16 years for the most serious offenders with the greatest culpability. But it gets even worse. The new guidelines make clear judges should refer to the Equal Treatment Bench Book before sentencing offenders. The handbook includes open-borders propaganda, comparing levels of asylum applications and stating there are “significantly less than Germany, which received 244,132 applications, or France, which received 156,103 applications”. In a section about anti-Muslim discrimination, the handbook uses the definition of Islamophobia that was drawn up in 2018 by the all-party parliamentary group (APPG) and was widely criticised, including by prominent Muslim groups. It also cites the Muslim Council of Britain. The handbook is another concerning example of the politicisation of the judiciary. Sentencing decisions should be made on the facts of the case, not on activist guidelines which are pro-open borders. The judiciary should not be engaging with the Muslim Council of Britain as they remain close to Islamist extremists. The APPG definition of Islamophobia is a Trojan Horse for a blasphemy law. The judiciary should stick to established law to tackle anti-Muslim hate, not writing in ever more expansive definitions by the back door. This is yet another example of the Sentencing Council acting in a way that disregards Parliament’s will. That is why I brought forward a Bill to restore ministerial oversight to the Council and empower Minsiters to block their guidelines, but shamefully Labour opposed it. Some of us have mentioned these people before, pointing out their unelected influence can destroy democratic mandates, but others are just stuck on 'red rosette good' and some fantasy about anyone that points at Labour failings must be a tory.
