I think the PL is liable. Can't completely pin this on Everton. Everton, City just doing what they can get away with. PL is at fault for not enforcing rules. The PL SHOULD be sued £300mill.
Would you apply this idea to the world at large? Crime is the fault of the police for not adequately enforcing the rules? If either or both clubs are found to have broken the rules, there is no such mitigation, even if others have been lax in their enforcement.
How in any world can anybody even think that? Here is a manager who has built an amazing team which will go on to win their 4th title in 5 years. Fighting against complacency and keeping the hunger going. Arteta has overseen a team which has really bottled it when the going got tough and will end the season without any trophy. He was helped by going out early in most of the cup competitions. While Pep had to compete in multiple competitions and will very likely win the biggest 2 cups available.
Also arteta has spent as much money as any other manager since he took over arsenal. I would apply it in some cases. Police not so much. If someone robs my house, it's not the police's fault: If police deliberately turned the other way and ignore crimes, yes they could be partially at fault. I wouldn't consider them at fault for crimes happening, but if they willfully chose to ignore enforcement, yes. Police incompetence isn't the problem it would be police willfully choosing to ignore crimes that would be. A more comparable situation to me though to the Everton situation would be: If you live in a building, and the person above you often overflowed their bathtub, and it cause the ceiling above yours to deteriorate, and you reported it to the building owners and they did nothing. The building owner would be at fault too if the ceiling came crashing down causing damage to your property. In this case the Premier League owns the building and are wilfully ignoring complaints about Everton peeing all over the floor, overflowing their financial bathtub and braking rules. The Premier League could stop this and has probably signed what the rules are but have failed to act in a timely manner. When the ceiling collapses on the rival teams... The PL is just as guilty as Everton for not correcting this mistake.
If you have the money, you can drag out the legal process for a very long time and if you lose like City did before, you just have to appeal to another body to overturn the verdict. With all the oil state involvement in the Premier League, it is becoming something of a concern that football will be damaged by these unscrupulous clubs and their crooked dealings, which they seem to get away with, by using money to game the system
If a law or a rule is broken the responsibility is squarely on the law-breaker. Those meant to enforce the law might be deemed negligent, but that in no way mitigates against the transgression - it's a separate issue. Regardless of whether or not the PL should have done something, if either club is found to have broken the rules as they were stated then the full force of the punishment is appropriate. If someone cheats, it's not ok until they get caught.

yes but the people suing are suing for damages as a result of the offense and no punishment. if the rules were changed to immediate transfer ban while under charge and requirement for this prior to January window then at least some restriction is put on the club. for example city could appeal anything they wanted for as long as they want but they cannot make a transfer in the meantime. or at least Everton would be under some sanction. you are right that the rule breaker (everton) are responsible and have to be held to account but if it could be proven that taking so long to hold them to account means other clubs are damaged then those clubs may well have some case to bring. burnely I wonder about as they went down last year but Everton were not 17th. whoever is 18th this season could suit if Everton are within a couple points however no precedent for point deduction has been set so i can't see how they can prove they were harmed. did Everton buy in January? have Everton done anything bar play 38 games as they would have done so who is to say what level of fine, transfer ban or points deduction is right. the issue is that there is no system here St all to punish dopers.
The thing is, this isn't a criminal matter it's a civil matter. At very least, if PL doesn't follow through with enforcement they're guilty of breach of contract which has cost those other relegation zone clubs hundreds of millions. I'm sure there are mounds of paperwork signed by both clubs and Premier League stating you must follow the rules and we are responsible for enforcing them. Lawyers could press the case that PL breach of contract cost their clubs in the hundreds of millions of squid range. I'm not saying rule breakers are absolved from ultimate responsibility, but Premier League failure to act could be seen as a breach of contracts (that surely must have been signed, and if not at least an implied conduct). As captain of the premier-ship the Premier League has final responsibility for what happens.
its an interesting point. in theory liverpool could sue the Premier league if they fail to actually enforce ffp as ffp is central to any investment made by fsg. if there is in effect no ffp as city are never punished or Everton can "lose" 300mil and get a 20mil fine for it then all investors can say the Premier league has failed to deliver. however equally it only takes 14 clubs to vote to force this enforcement and change rules to hammer clubs.
A draw against Brighton is almost as good as a loss here. Two draws in their final games.could leave us with a potential to draw on points and then it comes down to GD. I have faith our team can get a cricket score on the final day against Soton if they're pressured to do so.
Well I'd rather the win for Brighton as it ends any talk of gd. I'd take the draw and chase goals in the final games and hope they draw another. newcastle have to screw the pooch twice. tonight is by far the hardest game they have. fingers crossed for Brighton to go do us a massive favour.

I'd definitely prefer the win for Brighton, for sure. In order for it to matter either way Newcastle as you say, have to mess up twice. That means their 4 goal advantage they have now will be at very best just a three goal advantage (and very possibly less than that) when you remove the two screw up results. If Newcastle screw up twice they won't have a comfortable cushion and will need to get a good GD in the one game they do win to keep us away.
