I had this situation. A chap who ran a car body shop got closed down due to a housing development next to his workshop. I said that he could come and work for me. HMRC said that he had to be an employee, he wanted to remain self employed. Eventually they just backed down after I said I would not employ him and he would go on the rock and roll.
I'm usually against tax dodging & swindling the Government , but **** them they will only steal it & waste it .
