Alleged sectarian breach of the peace

    Now, imagine if you will that I have moved to a terraced house in Glasgow where I play The Damned's Machine Gun Etiquette LP (containing the song Anti-Pope) at full blast. Frequently. Let us consider two scenarios:
    1) I have Protestant neighbours on either side
    2) I have Catholic neighbours on either side

    What would be the appropriate punishment in each scenario, an ASBO for noise nuisance or a prosecution for sectarian breach of the peace?

    So "**** the Pope" is sectarian but "I'm anti-Pope" is not?

    I think it comes down to: sectarianism is about who is making the complaint and this is the issue you are dodging. "**** the Pope" implies: "I'm a proddie and I hate catholics" whereas "I'm anti-Pope" implies "I'm a punk and I reject figures of authority such as the Pope". But how do you prove the thought behind the words in a court of law? Is Scotland to outlaw criticism of the Pope or will this legislation end up on the garbage heap where it belongs?

    What I was trying to get at webel is when does criticism of the Pope become sectarian? Under what circumstances is it ok to call the Pope a ****?

    There should be nothing wrong with being openly anti-Catholic. The Catholic churches teachings are so far removed from modern society and their followers dwindling in this countyr (as much as any other Church) they deserve an increasingly smaller amount of press but are constanlty outpsoken on everything from gay marriage/adoption to pointing their flock in the direction of who to vote for.

    If a young man wants to demonstrate his opposition to the Catholic church and what they stand for in an orderly manner then it's fine. In this country he has a right to do so. If he wants to do this in an attempt to offend or start an argument/fight then there are already laws to deal with this and punish his behaviour.

    You can conduct a reasoned critique of the Pope, Catholicism and Catholics any time you like Med BullDog. However I would suggest that your belief that charging a man or allegedly roaring "**** the Pope" on a boozy night out with a sectarian breach of the peace is anything but a sectarian breach of the peace is quite frankly ridiculous.

    This kid is not Martin Luther. This is not a religious crusade. Nor is this kid Martin Luther King. This is not taking a stance against an erosion of his civil liberties.

    Stupid enough not to understand the inner workings of the mind of a fool.

    Months ago he would have been charged with the centuries old 'Breach of the Peace'. He would have been nicked and charged on the Monday morning. The difference in punishment he will receive if found guilty is down to exactly what he is alleged to have shouted in the street.

    The whole thing is eroding free speech. That is the crux of the matter and you are unable to be open minded or unwilling.

    I prefaced my initial post on this thread with "for what it is worth". I then gave my opinion which is backed up by law. We then had MedBullDog coming out with outragous ****e and T revealing himself as a complete ****ing looper.

    Now either i am right, or i am wrong. You and I both know that what I have posted is wholly accurate. What I think or don't think about the Pope is entirely irrelevant to this thread. Do you accept that?

    If you hate the Pope because he is the head of the Catholic Church....your hatred is sectarian

    If you hate the Pope because he is German....your hatred is racist

    If you hate the Pope because of his opinions....your hatred is political

    If you hate the Pope because your daddy did, and his daddy before him....you are Medro Pendes

    It doesn't make any hatred worse than the other....it just means you need counseling to get over your hatred for a man who has NO effect on your life
