Off Topic What kind of punishment....

    Cut a long story short, a lad that's pretty close to me took his mams car last night without her consent. He took his younger brother with him and decided to drive like a fecking d#ckhead reaching speeds of 80mph and he lost control after hitting a pothole and ended up in a ditch with the car upside down, nearly killing himself and his brother.
    Thankfully neither were seriously hurt. When the Police came they breathilised him and he was double the limit for alcohol.

    He is now in the cells and his mam has not got a clue what's happening or what's going on. Hes been in there since about 9 oclock last night. Her car is a complete write off.

    Does anybody know what kind of punishment he can expect to get for this?

    For driving over the limit, it would be driving ban, fine etc. If his Mam hasn't give her consent then that's also twoc and he's walking a very fine line.

    If he has previous, I'd suggest he may very well receive a custodial sentence. If he hasn't he may get away with a suspended sentence.

    I'm no solicitor, though. I could be miles out.

    Depends if his mam says he had consent or not, mam's are daft with these things.

    A lot depends on whether or not he has a full licence and insurance.

    Plus, whether or not there were witnesses or camera evidence of his speed and manner of driving.

    If his mam says he had permission, his speed/behaviour can't be confirmed and he has no previous he could get away with a year's ban and a few hundred quid fine for the drunk driving.

    No idea, but a pretty harsh one hopefully. Lucky he didn't kill someone and find himself up on a far more serious charge.

    Year long ban from driving, 6 months inside (probably suspended) or 30 hours community service.

    No idea tbh. Mate di d similar, but didn't have a big crash. He was 5 times over.

    I've told her not to say that otherwise her insurance might not pay out and he needs to take responsilbilty for his actions

    If his Mam says she give permission, is he insured to drive the car?

    Yes he does. How would that effect her insurance paying out though? If she puts herself in the firing line they might hold it against her

    She could get herself in trouble. They could well try to say she knowingly handed him the keys when he was under the influence. I'd carry on talking her out of it, tbh. Not sure at all about insurance, but probably not good.

    Agree with the consensus on here, punishments for this sort of thing are too soft. I worked with a scouser who 7 or 8 years ago, got pissed up on about 6 bottles of wine and took the car out. He hit a man in Hebburn and killed him on the spot. He got 6 years and was out 2 and a half year later.

    Again, no expert here but I'd be amazed if there isn't a clause that says the policy doesn't apply for an incident the happens while driving over the limit. Think your advice to keep quiet is the right one.

    Prison sentences mean feck all now. I know a lad who was sentenced for 8 years in 2007 for being found with 100k worth of drugs in his boot after somebody grassed him up.
    He was out 4 years later, and in 2016 he was again caught in a drugs trafficking ring that he played a big part in. He was sentenced for 10 years this time. He got out last year and hes now bought a bar with the drug money he had stashed away ready for when he was released.

    This needs careful thought mate.

    If she says he didn't have consent that's theft.

    Without consent the insurance company may say there is no cover.

    If there's no cover they won't pay out and she'll lose out unless the lad writes her a cheque.

    However, if he's previously been allowed to use the car that could be construed as implied consent.

    The cars worth about 6k, hes a 20 year old student so theres no way he can afford to reimburse her.

    I know it's a difficult one, she needs to decide what to do for the best before she rings the insurance company. I think she should be honest and tell them he took her keys while she was sleeping. The insurance company will do whatever they can to prevent paying out so if she gets herself involved to try and help her son she could find herself without a car and no money to replace it with

    I know of one case where mother had to have her son charged for twoc otherwise the insurance company would not pay out, though it was a while ago.

    Think they need to look very closely at the insurance policy

    I'd think the reverse.

    If he's stolen the car then he's not insured unless he's a named driver.

    If he has consent, and previous use, she's covered for the loss if its fully comprehensive.

    If he isn't insured on the car she can get done for allowing him to driver her car without insurance, a decent amount of penalty points and possible fine! So insurance will definitely void her policy too.

    It's to prevent people sticking up for mates and family who two there car.

    Disagree mate, if he has stolen the car she should be covered like any normal theft.

    If he is named driver with use of the car and has took it like he always does he has been over the influence when he crashed so insurance company will not pay out.
