The issue is the ARB isnt in the public domain and thus MA and NDM do not have confidence that the ARB decision will be correct.
Arbitration will correct any wrongdoing is what he is now saying and therefore should be allowed to proceed giving the new owners plenty of time to operate in the winter window.
Which is actually a fair point. But there is no confidence it will happen fairly. That is why CAT is here.
Only just tuned in but doesn't sound like SJH's CAT case has much if any merit. Arbitration will be another kettle of fish.
All that has happened so far is the PL argument as to why the case shouldn't go ahead yet. Danny Jowell yet to go up and bat, PL have tried to hide behind confidentiality and the judge so far doesn't like that idea.
What he is saying (PL chap) is a fair point in that the CAT case is not needed if ARB rules legally and fairly. He is quite right however the problem is that the PL have procrastinated that much that the deal hinges on PL survival and also PIF being at the table. The argument of delay tactic then comes into play.
Also lets not forget - the PL made it perfectly clear they were only prepared to have arbitration regarding the point of separation. They do not want any of the other accusations coming out today.

I think that exact point will be made and repeated 10 times come about 14.20 as soon as Danny Jowell gets up and speaks. By the sounds of it though. At no point has this guy sounded confident in the PL's argument that the KSA should be named a director. It sounded like he was saying. Let Arbitration deal with this. It will take about a week. The O&D test presents no issues for those already listed, transfer of ownership would be done in plenty time for the owners to operate in the window.

So we have a date for ARB. 3rd Jan I think. And a week for it to fall in favour of the PL because behind closed doors and with an ex PL employee as the lead judge, how can that be impartial. It’s the whole reason for CAT. To expose the lies and prove the fact that the PL deliberately, under heavy external influence, demanded that KSA be a director to then fail the O & D test.
