They are trying to use a technicality in which the CAT case is not needed as is already happening with the ARB and that NUFC and SJHL are one and the same in this context. The fact that the case content is different in each case doesn't seem to have been brought up yet.
NDM definitely looks like he is getting in the game now doesn't he. So basically this chap is saying the CAT claim is "superfluous" because the ARB case would have resolved any issues and that by the very decision itself from ARB one way or another, following the rules, would rule out wrongdoing.
Pretty much - I'm sure he even said that there may be a case for anti - competition, but that arbitration should be heard first
Finally a fact. "If the ARB concludes that KSA is not a director then the deal goes ahead". Thus CAT isn't needed.
