The thing with arbitration is it was made clear the PL would only go into arbitration to cover the grounds of separation only. They aren't going to touch anti competition stuff, ESL, corruption or anything else. Arbitration is for the club to prove that PIF and the Saudi state are separate legal entities.
CAT will not throw out. Arbitration = separation question only under Rule A. Rule X sets out the arbitration powers. Rule A leads to Rule F and the possibility of further dispute thus going back to Rule X. CAT = The whole test is anti-competitive. The latter falls outside of the scope of rules A, F and X. PL arbitration does not have jurisdiction to hear such claims. Arbitration and CAT are not the same material facts.
