Can’t say I’m an expert in any of this but given the clubs are the ones that pay the players, surely banning them from playing is stopping them earning so must be some kind employment law that’s being abused here.
Interesting one this. That rule was to stop clubs holding on to international players when it suited them, it was not meant for global pandemics. If FIFA have any sense, they will set aside a ban this time and say that the risks of players travelling particularly to high risk areas can be taken into account while the pandemic is still an issue. But who said FIFA had any sense. Bungs work, always have for FIFA
Employment law doesn’t come into it, as the ban is due to the actions of the clubs not the players, so wages couldn’t be withheld. The issue boils down to the PL putting its needs before international football, solely because of current UK COVID regulations. I see both sides of this & we’ll see how the appeal goes.
simple solution to this. send the bill for their wages to fifa on the ground that they agree to pay for players injured on internationals. Ergo in this case internationals prevent players from playing for their clubs. As it stands the UK requirement is to isolate for 10 days after travelling for a red list country and it must be served in a hotel. so players lose 10 days and then are not fit etc etc due to isolation. call it 2 weeks out. fifa ban is 5 days. clearly the clubs are already ahead in his argument even if they have to take 5 days ban. Given the risks players were put to by some players dodging rules and the abandonment of the game it seems to be the Brazilians are being extremely petty and will only have made some enemies. best of luck getting a player for anything again and best of luck if you want a vote in future.
Nah, that pig don't fly. You join an association and you abide by its rules. We sort of had this over the Suarez business - by most qualified opinion, most FA tribunals (certainly then) were little more than kangaroo courts. Even if you're just appealing about the length of a ban/penalty. you run the risk of it being even more, and all the CAS will do is check whether the governing body, in this case FIFA, followed its own agreed procedures and sanctions. Can't see this rule being enforced. And that's simply because they are allowing Richarlison to play - it's a either rule for all or for none. But it is interesting how FIFA ignored UEFA’s ban on Hungarian fans as it's a UEFA competition that the fans racially abused players but are happy to affect games played by the English FA and UEFA??
I would put a chartered flights, players wages for 10 days and the most expensive hotel in the world together as a bill and send it to fifa and say your rules require player to go so here is the bill for red list countries. stump up I would put this at about 250k per player affected. each and every time they get called up. that would soon soften fifas' cough. the hilarious thing is brazil cannot non qualify for the world cup. its actually nearly impossible so this is entirely pointless of them.
yuo are right it cannot be ignored. it is a rule and if you play the player then the fa will simply have to fine you and give a points deduction etc. It has to be appealed not ignored. The prem is a fifa approved comp.

As I understand it they’ve invoked the rule that says a player can’t play for his domestic club for X number of days after the last international if his club have refused to release him. So the action is taken by individual player / club, they’ve cut Everton some slack as we released Richarlison for the Olympics when we had no requirement to.
a body who until recently had an exemption to the rule for this precise scenario and knew in advance what was happening and said and did nothing . Oh and also the body who decided the Puskas stadium could have 60000 Hungarian supporters as the existing ban was "just" a Uefa decision . The converse argument is that the clubs were simply putting themselves first as they’d have lost their players due to UK rules for 1 or possibly 2 games. So they stuck 2 fingers up to FIFA and refused to release players heading to Uk defined red zones, surprisingly FIFA have backed the nation who complained.
