    This is the QC the PL are using - the image is from the website below. Obviously references Arbitration and the CAT case, but also mentions a commercial court application pending. Is this the CAT case, or is this a third legal battle?

    Commercial Court is the High Court. I think that will be an appeal against CAT if the case isn't thrown out.

    I wouldn’t have thought so. The two are not linked. The o &d test would be on the new directors but the current one (Charnley) still has a responsibility to complete his duty as director. Which is file the accounts and approve the accounts.

    That in itself may be an issue. Maybe he is refusing to approve the accounts. Who knows.
