Exactly mate the only fact is that its been delayed. Unfortunately there's been thousands of emotional wrecks sitting waiting for the big news and they've jumped to the worst possible opinion on it. All the makems and other fans came out waking in their faces and they've taken the bait. Let's just see what happens and not jump to any rash conclusions. It's not over until its over...
CAT could take years. ARB could be delayed again. PIF won’t wait forever. We could get relegated. Anything could happen. But thus far the PL have won things as they stand. The club statement does not say they “accept” the delay. I will however agree that it paves the way for a negotiation or ARB. But I think it’s highly unlikely.
@Roy Munson Ok, here’s my other spin on it which I think is dangerous. AS and co make one last move for ARB to be public: PL say no. Thus, the club, AS and PIF say “ok then, we prefer CAT over ARB as it exposes all your lies and gives us a better chance of winning”. BUT, CAT is not for separation. So CAT has to conclude and then ARB has to happen once everything is out in the open. I do find it suspicious that the club have made such a brief statement. It does sound like maybe it’s what we wanted all along!
Another take on this is that the recent transparency argument from AS is to show the public the evidence “we” have been asked to provide which is maybe unreasonable? Thus it is “us” that has caused the delay because we won’t provide the evidence which may be detrimental to the decision!
What we actually wanted was the two parties to come to a settlement and the ODT test repeated and passed, and then CAT dropped. AS & PIF are business people - they just wanted the takeover to go through as quickly as possible. They couldn't give a toss about the CAT, and are probably not even involved in that. I am with @Roy Munson that it's not necessarily over yet but a delay of this nature just gives the potential buyers more time to get cold feet, change strategic direction etc. Its very hard to see this delay as anything other than a huge win for the PL. After all they have been trying to delay matters all along so another delay suits them fine.
@Rafman must be over the moon though now. With a potential takeover being delayed by 6months, Rafa may be back in the running, when he is sacked by Everton in December.
That's just it, arb is a single legal point. Someone or both sides, has failed to comply with disclosure. If it is NUFC, then it could be a tactic to force this into the public domain via CAT. They wanted arbitration public and were refused. What better way to bypass the PL? Go to CAT, widen the legal issues and force full disclosure of everything. If true, it is a very very clever tactic.
But as @JakartaToon states (and I have said it’s very risky also) why would PIF and AS want that re CAT. Honestly when you think about it you don’t bite the hand that feeds you. They have to work with the PL if it ever goes through so PIF and AS don’t really want that. MA on the other hand probably does. He doesn’t give a ****!
As a result of the breaches by the Defendant, the Claimant has suffered loss and damage. Delay delay delay... They've got no grounds to fail it. They sat around and bird&bird said we can't fail it, but what we can do is make it take a long time. They asked how long and they told them If we play our cards right maybe 2 years and that's IF they don't give up or IF Newcastle don't get relegated. They said OK let's do it That's it imo.
That's fine if we sign willock on loan we've got enough. We've been 10th best for the full duration of the correct set up including willock and Jones
Ashley wants his sale. He also wants to take the PL down. NUFC's statement was very interesting. They are usually bullish and vitriolic towards the PL. This one wasn't.
I can't see Ashley just giving up over another 5 or 6 months which in business is a small amount of time. The same applies for the buyers I believe they've dig their heels in now and will see this through.
