Not sure what has been said on this previously so thought I'd throw in my two pence of knowledge. It's been a while since i worked in it but as it was (if i recall correctly) arbitration is usually the only allowable route for large scale organisations who have previous contractual relations as they'll have a clause saying arbitration must be followed (A Scott v Avery clause) before any court proceedings can be lodged. The decision is then immediately legally binding and, usually, there is no right to appeal. You can apply to a court to over-rule the decision but only if you can show (or convince the court you have) a point of law which has been applied incorrectly (in other words you can't go to court just because you're unhappy with the result of arbitration or think they got it wrong, you need to be able to point at something you think they misunderstood or applied incorrectly). This means that if we lose arbitration it would probably be wrong to assume we can then just go to court. It does depend on the contract in place though, the reasons for the decision and whether there is an argument the law was mis-applied. I think we'll lose in arbitration then there will be a drawn out saga of potential for bringing court proceedings which the EPL will argue we have no right to. That would be great fun of course.
Is that the specific appeals tribunal the EPL and NUFC have signed up to is it? I've not followed the situation at all to be honest but people keep saying arbitration so that's what i was talking about, CAT is a tribunal. That's not the same thing. Are people just mixing up their terminology here?
I was about to start shouting “fight fight” and I wasn’t involved so I’m poking it. Just for the laughs and giggles. @Roy Munson your right. It’s anyone’s guess what happens. @Darren Peacock's Ponytail your right. It’s anyone’s guess what happens. Fighters, are you ready..... 3-2-1
I don’t think I do. We all know ARB is going to decide the takeover. CAT will not have any influence on it. That is a just in case scenario for MA pockets. If ARB is lost. Then CAT is all about exposure. Not takeover.
Some outrageous slander towards Hayden and Lascelles in this thread. Both helped drag us up and stabalise us as a Premier League club while others cried off. Hayden is a good Premier League box to box midfielder that can do a bit of everything and Lascelles is a solid top-flight defender that works best in a three. Also, good to see arbitration is moving closer and close. Regardless of the outcome, we know one is at least due soon, which is a relief. If the club win there's nothing stopping the two parties coming to an informal agreement about sanctioning signings etc.
Just had a quick glance and saw this https://www.catribunal.org.uk/sites/default/files/2021-05/1402_St_James_Summary_060521.pdf (which i assume was already discussed so i'll move on). I'd say this is worst case scenario if it goes that way. EPL would just ignore the bleating and it would make NUFC fans look worse and be used by Ashley as a smokescreen to refuse to invest in the club in any way. The only person gaining from the holding pattern is Ashley as far as i can see.
Have to agree with you here. Both Hayden and Lascelles have a place in our squad. Both give 100% however I think Lascelles hasn’t moved on as I expected. But still a solid defender for us. Hayden is limited but as a defensive midfielder who works hard he’s sound. Put a better CM next to him and it’s a perfect match.
Yes your probably right. However CAT is not really what MA wants. If ARB loses then I personally believe CAT is difficult to prove. So I think CAT is just a leverage tactic at best. But if ARB loses for MA that’s not good news for him. He doesn’t sell the club and he’s got an asset he doesn’t want. Also becomes practically unsellable for anywhere near 300m. So he’s relying on CAT to hedge his money which won’t come anywhere near. All that CAT would achieve is some PL dirty laundry out in the open. It doesn’t do anything for MA. Hence all the current movements from the club, MA and AS. I feel ARB will go out way. But if it doesn’t. Basically we ate ****ed!
Thankfully Hayden was injured or we might not have seen willock reintroduced after he was pulled off vs Brighton? and left out the next game I'd rather Hayden than Hendricks though Lascelles is a big lump, but he's dreadful on the ball and always going long. Schar and Lejeune are far superior. Both players have served us well but they ain't good enough. Squad fillers imo.
If it was up to me I'd want our midfield to be Sean/Matt, Willock and Hayden. Perfect blend of technique and legs.
They're both ****e. Lascelles is Championship at best, probably more league 1. Simply isnt good enough. Hayden I just don't get what anyone sees in him, they think he's this tough tackling holding midfielder but he's just a clumsy knacker who gives away daft free kicks all the time
