The PL don’t want it played out in public because their brand could take huge damage, this part could be more important than the actual case for numerous reasons, the Ashley lawyers are making out the PL are hiding something, so where do they go from here, they either cave and drag their brand through the mud, or they keep it private and let everybody think they’re acting snide. It’s lose-lose for them, a master stroke, cos the alternative is a settlement that keeps everybody happy and the brand intact.

I still think an out of court settlement/agreement will be reached in the arbitration and the CAT case will be dropped, allowing the takeover to occur. Its all just the usual posturing at the moment to ensure the two sides can get the best deal for them. Its not unusual for legal proceedings to start and a settlement to be reached during them. I think that the CAT case is only there to put pressure on the arbitration as its unlikely to result in a ruling that the takeover should be allowed to go through per se - more likely that the ODT process is unfair in its present format and should be carried out by an independent body to which the prospective buyer presents evidence, the body makes it's decision and both parties have a right of appeal. Possibly with some compensation for costs incurred etc. The whole issue is muddied by the fact that each club (including Newcastle) is a shareholder/member of the Premier League so is party to these anti-competitive practices. I have never seen any evidence to suggest that it has at any time submitted a proposal to the PL to change the method by which the PL carries out ODT's.
It's a clever tactic by experienced QC's who know what they are doing. If it harmed NUFC's case the legal team would not have allowed the statement to be released. NUFC has in effect called the PL out. As above, the brand damage could be irreparable. I think we may see a settlement. It is not borne from desperation nor is it evidence that NUFC are losing. That is just nonsense.
We can pretty much say that the PL's attempt to get CAT thrown out has failed do they are now trying to get it heard in private. That is contrary to CAT'S own principles and the purpose by which they were set up under the Entetprise Act 2002. Arbitration is probably about to start.
