Compo is a back up if arbitration fails. CAT can award an injunction to force the takeover through if they find that the ODT breaches competitiin law. They will and the PL knows it.
Arbitration is in secret. The only thing being made public is the decision. I would expect arbitration to last a week-ten days. The decision may take weeks as the panel then has to review the law and write up their judgements. They can however give an expedited judgement due to the necessity for planning for the new season. If it starts tomorrow and the above is correct then the next couple of weeks will be crux.
This is it for me. The longer it goes on it seriously hits next seasons plans. It’s not fair on the current staff either and that includes Bruce.
That’s what I’m hoping but I honestly believed that if it wasn’t going to start then a decision would have happened by now.
Where have people got the start date of tomorrow for the arbitration hearing? From the Court judgement earlier this year re the Panel Chairman: “In arbitration proceedings with Newcastle United Football Club, which are said to cover materially identical issues to those raised in the Claim and which are being heard on an expedited basis in July 2021.”
I think it was George Caulkin who suggested between 28th June and 1st July. In any event, July is the month. It is nearly over.
Not sure how the ODT itself can breach competition law. I would have thought that CAT could decide that the ODT should be performed by an independent body, as it is anti-competitive that it is carried out by a body that represents the competition. Not sure how CAT could award an injunction to force the takeover as an ODT still has to be performed as per current PL rules.
Yeah, not buying the injunction angle. Isn't it just: PIF: "here's our director for the test, Yasir." PL: "what about MBS?" PIF: "he's separate" PL: "we don't believe you so can't start the test" NUFC: "you're being ridiculous, PIF are separate" ARB: either "yep, test PIF" or "nope, test MBS" If they start the test with PIF separate, it sails through. Or they could fail it and face more consequences and drag it out further.
I don't understand all the negativity even if I'm wrong at least you'll know its the end game over the next month
