Evidence suggests it's going to happen. Ashley being bullish and saying he wants it done within a month or two, Staveley on Bloomberg, NCSL/Keith being supremely confident (he has seen evidence), Ashley taking on the NCSL case, PL delaying (yet again) and the wide amount of scrutiny they are inviting upon themselves. If they lose this CAT claim, every club that's ever felt wronged by the PL can sue. I don't know who's advising the PL, but to my mind they're doing an astonishingly bad job.
Ashley might win his CAT case, but I don't see any way in which NUFC can win the arbitration when Beloff is the one who will ultimately make the decision. The PL knew they had it in the bag when they wangled that one through.
It’s beyond me that one man, Beloff, literally has the power to change the course of history for NUFC and the local area. Literally millions and millions of pounds of investment and jobs created for people in the NE. And one man can stop it as he is unfairly biased towards the PL.
Basically it shows that the UK courts are as dodgy as the PL themselves. It was a scandalous decision to allow Beloff to remain in place.
I actually hope wilders corner don't save him this time. He actually sacked him for that you know... He made up all kinds of excuses and accused fury of cheating... Nah he's too thick and too arrogant.. He firmly believes his suit was too heavy, his water was spiked, fury had eggweights in his gloves and that fury was on steroids. Just re-reading the high court judgement - Beloff provided advice relating to KSA. He told the PL that KSA satisfied the elements of control to qualify as a director. He failed to disclose that at the time he was appointed to the panel. The other two members- Lord Neuberger and Lord Dyson. Two of the UK's most respected retired judges. Thry take no ****. The High Court therefore said that the only issue for arbitration is whether PIF and KSA are separate and whether the definition of KSA as a director is correct. Section F of the PL rule then comes to play so thst the ODT can be applied. Basically, the separation is established then the test is a mere formality.
Exactly why I cannot understand the PL's delay. Just agree it's separate, get on with it and give the club a new owner and forget this whole sordid little affair.
This cat case being upheld is the key otherwise they'll take their chances at arbitration. Arbitration is a coin toss apparently
