I’m all in now. Ashley is turning the screw. Having thought about it from a legal perspective what argument do the PL actually have? The evidence is overwhelming against them and the ESL carry on highlights some shady ongoings.
Well we don't know I'm sure they know something went on, but knowing something and proving it are two very different things Fingers crossed
Indeed: like has been quoted the only legal leg they have is linking MBS to the ownership and directors and for me that’s not possible. He won’t own the club and he won’t be a named director. Thus all the **** connected is completely irrelevant from a factual basis. Control and him being able to exert any is pure speculation.
Perhaps it is because arbitration has started or because the club has initiated subsidiary legsl action. The PL won't want their corruption exposed. The deal will get passed.
I’ve thought long and hard about the new legal case. And I’ve read the detail a lot. Like A LOT. When you strip it back it is a threat. The timing of it being dropped (22/04/21) was perfect. Re ESL the day before. I just think Ashley (or his legal team) are playing the game perfect. The fans in general will see the takeover denial and the subsequent fallout as the Big six and the corrupt PL denying competition. What a perfect angle to take.
The control argument is a myth. He is chairman and de facto head of state but there are a board of directors who have equal voting rights. As chairman MBS has casting vote. That relates solely to changes in the PIF constitution. It is within PIF's articles as put in by royal decree. Bander Mogren and Yasser Al Rumayyan are the real power. They are responsible for policy and investment decisions. They run PIF as on behalf of the state but as a legally separate wealth fund. MBS has minimal intervention. Thst isn't just my opinion, that is the opinion of experts in Company and Middle Eastern law. The PL are so far out of their depth with this one.
Aswell as the competition argument there is also the loss of investment in the area. Jobs being denied. World trade relations damaged. Business deals which would generate tax. All stemmed because of the PL being controlled by the big six and Bein.
It is a threat that will be terrifying the PL. If NUFC are seeking full disclosure then it will all come out. Proof that fans of 14 PL have always suspected- a PL run for the benefit of the top 6. Cartel conduct that is contrary to Competition law. The CMA will be very interested.
Which in the bigger picture (pun intended) is a PR disaster for the PL. Currently the PL are standing on the edge of a canyon. The next bomb will be the 14 owners asking why the PL have not punished the big 6 yet? The big 6 pre meetings before the 20 team meetings will be minuted. This would be classed as evidence. The minnow 14 group snap chats will contain a mountain of interesting information. The letter from the leader of Bein to the big six requesting for the takeover to be blocked. ON WHAT GROUNDS?
Of course this could be a domino effect. If NUFC go through with their threat and win the case, it gives grounds and standing to the other 13 PL clubs to sue the PL.
That right there is evidence of pressure. A commercial partner involving themselves in a takeover. The IP infringement angle is a separate issue.
this is the key point. It will open the floodgates which in turn will cause the league to fall apart. Now the big 6 have been exposed the only way to disprove the theory that they are the ones running and influencing the PL is to pass the deal
Yes good point. I don’t know how the legal world works. Now that the case has been made official can the PL say “ok let’s negotiate the arbitration, we give you the official go ahead with certain clauses. One of which is you drop the legal case!” Can that be done now it has been brought up?
