The Jury do not have to decide any aggravating factors in this case, the defendent has opted for the Judge to make that decision, not the Jury. Therefore if found guilty, the judge decides the sentence, from anywhere between 12 years to 40 years in prison. Not quite sure how that works, I just remember it being part of the summing up process and one of the decisions Chauvin had to make.
